بایسته های جرم انگاری در حقوق رقابت و رویکرد نظام‌های حقوقی نسبت به آن

بخشی از ضمانت اجراهای حقوق رقابت، با استفاده از حقوق کیفری و جرم انگاری رفتارهای ضدرقابتی محقق می شود. در این شیوه به‌واسطه اهمیت حفظ رقابت تجاری در بازار، با اتکاء به سازوکارهای حقوق کیفری موثرترین و کارآمدترین شیوه تضمین ضوابط حقوقی مورد استفاده قرار می گیرد. هدف این مقاله با استفاده از مطالعه تطبیقی، تبیین مولفه های موثر در تحقق کارآمدی ضمانت اجراهای کیفری حقوق رقابت و بررسی و ارزیابی موضع حقوق ایران است. این مقاله تلاش می نماید ضمن تبیین ضرورت مداخله کیفری در حقوق رقابت چگونگی تعیین تناسب میان ضمانت اجرای کیفری و رفتارهای ضدرقابتی را بررسی نماید. با وجود برخی ظرفیت های قانونی در ایران، پذیرش مفهوم ضمانت اجرای مطلوب و اصلاح قانون و رویه های موجود بر این اساس ضروری به نظر می رسد. این امر متضمن به رسمیت شناختن تاثیرپذیری حقوق از مولفه های اقتصادی، اجتماعی و فرآیند هنجارسازی است.

Criminalization of Competition Law, Dimensions and approaches of legal Systems

Part of the enforcement of competition law is achieved through the use of criminal law and the criminalization of anticompetitive behavior. In this method, due to the importance of maintaining commercial competition in the market, relying on criminal law Mechanisms as the most effective and efficient methods of guaranteeing legal rules is used. The purpose of this article is to use a comparative study to explain the effective components in realizing the effectiveness of criminal law, enforcement guarantees and to review and evaluate the position of Iranian law. This article tries to explain the necessity of criminal intervention in competition law, how to determine the proportionality between criminal enforcement guarantees and anticompetitive behaviors. Based on some legal capacities in Iran, it seems necessary to accept the concept of optimal enforcement sanctions and amend the existing law and procedures accordingly. This involves recognizing the impact of rights on the economic, social, and normative components.
