دیوان کیفری بین المللی و معیار شدت مندی‌؛ از چالش های نظری تا اشکالات عملی

یکی از مکانیزم های مهم برای قابل پذیرش بودن یک وضعیت یا قضیه در دیوان کیفری بین المللی، معیار شدت مندرج در ماده 17(1)(د) اساس نامه رم است. عدم تعریف این معیار در اساس نامه باعث شده است که نهادهای دیوان مولفه هایی برای تشریح آن منتشر نمایند و ابهام آن را بردارند. اما این معیار، در خود چالش‌های نظری دارد که نیل به اهداف دیوان را با دشواری مواجه می نماید. در کاربست این معیار نیز برخی ناهماهنگی ها دیده می شود و گاهی مصلحت بر عدالت تغلیب می یابد. در این پژوهه، به چالش های نظری و اشکالات عملی این معیار پرداخته شده است. یافته های پژوهش نشان می دهد که در کاربست معیار شدت‌مندی، رویکرد واحدی اتخاذ نشده است و میان نهادهای دیوان در تشریح این معیار اختلاف نظر وجود دارد. این مساله باعث اتخاذ تصمیماتی شده است که در عادلانه بودن آن ها تردیدهای اساسی وجود دارد و مشروعیت دیوان را با چالش مواجه می سازد.

International Criminal Court and Gravity Criteria; From Theoretical Challenges to Practical Problems

One of the important mechanisms for the admissibility of a situation or case in the ICC is the criterion of gravity contained in Article 17 (1) (d) of the Rome Statute. The lack of definition of this criterion in statute has caused institutions of the court to publish factors for its explanation and remove its ambiguity. But this criterion has its own theoretical challenges that make it difficult to achieve the goals of the Court. In applying it, also some inconsistencies can be seen and sometimes expediency overrides justice. In this study, theoretical challenges and practical problems are discussed. The research findings show that in the application of this criterion, a single approach has not been used and there is disagreement among the institutions of court in explaining it. This has led to decisions in which there are fundamental doubts about their fairness, and challenges the legitimacy of the Court
