مسئولیت کیفری موسسات خصوصی حرفه ای عهده دار ماموریت عمومی

به‌طور کلی اشخاص حقوقی را به دو دسته حقوق عمومی و خصوصی تقسیم کرده اند که قانون مجازات اسلامی با توجه به آن، در مواد 20 و 143 تا حدودی به تشریح نحوه مجازات و مسئولیت کیفری این اشخاص پرداخته است. اما در قوانین مربوطه به ماهیت و مسئولیت کیفری موسسات خصوصی حرفه ای اشاره ای نشده است، در حالی که این موسسات، شخصیتی مجزا از اشخاص حقوق عمومی و حقوق خصوصی دارند. بر این مبنا، این تحقیق با روش توصیفی تحلیلی ضمن پرداختن به ماهیت این اشخاص، مسئولیت کیفری و نحوۀ اعمال هر یک از مجازات های ماده 20 ق.م.ا مصوب 1392 را تشریح کرده است. در پایان این نتیجه حاصل شد که موسسات خصوصی حرفه ای ویژگی های هیچ یک از اشخاص حقوق عمومی و خصوصی را ندارند، بلکه حالت بینابینی دارند که لازم است قانونگذار در موارد ماموریت عمومی آنها را از مجازات معاف و در سایر موارد، مجازات های قابل اعمال را مشخص نماید.

Criminal Responsibility for Professional Private Institutions

Legal entities are divided into two categories: public and private. The Islamic Penal Code according to it, in materials 20 and 143 somewhat describes the punishment and the extent of their criminal responsibility, While these institutions have a distinct personality from government agencies and legal entities. On this basis, this research is descriptiveanalytical and studies the nature of these persons, the criminal responsibility and how to apply each of the penalties in Article 20 of the Islamic Penal Code. At the end it was concluded that professional private institutions have not characteristics of government agencies and legal entities, rather, they are intermediary and they should be considered a new entity. Therefore, legislators should be exempt from punishment in cases of public mission, and in other cases specifying the penalties applicable is necessary.
