حقوق متهم در آراء دادگاه عالی انتطامی قضات ایران و اسناد حقوق بشری

اعمال قواعد نظام تفتیشی، و حساسیت مرحله پیش از محاکمه از نظر جمع آوری دلیل و امکان خودسری مقامات قضایی، اهمیت آن را در مقایسه با سایر مراحل دادرسی نشان می دهد. از اینرو این مرحله در اسناد بین المللی حقوق بشر بیشتر مورد توجه بوده است. دادگاه عالی انتظامی قضات به عنوان مرجع رسیدگی به تخلفات انتظامی قضات، آرای متعددی در جهت محکومیت انتظامی قضات متخلف از حقوق و آزادی های متهم، در این مرحله صادر نموده است. بررسی رویه دادگاه انتظامی قضات نشان می دهد که آراء محکومیت متعدد و شایسته ای از این دادگاه در تضمین برخی از مصادیق حقوق و آزادی های متهم در مرحله پیش از محاکمه، صادر شده است، اما نظر به اینکه این دادگاه، شانی مشابه یک دادگاه حقوق بشری دارد، ولی در مقایسه با اسناد حقوق بشری، رویه قضایی آن، نتوانسته به طور جامع حقوق متهمان در این مرحله را زیر چتر حمایتی خود قرار دهد.

Defendant’s Rights in the Iranian High Disciplinary Court of Judges and Human Rights Instruments

The application of the rules of inquisitorial system, and the sensitivity of the pretrial stage in gathering the evidence and the possibility of arbitrative decisions by the judicial authorities, demonstrate its importance in comparison with other proceedings. Therefore, this stage has received more attention in international human rights instruments. The High Disciplinary Court of Judges as a reference for investigating disciplinary offenses of judges has issued numerous decisions in favor of prosecuting judges violating defendants’ rights and freedoms in the pretrial stage. A review of the judges ’disciplinary procedure shows that this court has issued numerous and welldeserved verdicts guaranteeing some of the defendants’ rights and freedoms in the pretrial phase, but notwithstanding of Companionship this court with a human right court, in comparison with  human rights documents, its jurisprudence has not been able to comprehensively defend defendants’ rights at this stage.
