نقد و بررسی مدل ارتباط شبکه‌ای میان دادسرا و پلیس در فرایند کیفری

روابط میان دادسرا و پلیس از موثرترین روابط میان نهادهای اجتماعی در مدیریت جرم می‌باشد. این روابط متناسب با نظام دادرسی‌ از مدل‌های متفاوتی پیروی می‌کند. این نوشتار با استفاده از استراتژی تحلیل منطقی و روش کتابخانه‌ای به دنبال معرفی مدل ارتباطی شبکه‌ای که سازماندهی آن متناسب با ماهیت نظام دادرسی اتهامی است، می‌باشد و در همین راستا به تبیین مولفه‌ها و پیامدهای این نوع از روابط می‌پردازد. چنین رابطه‌ای بر نوعی تعامل هم‌سطح و پیوند شبکه‌ای برقرار گردیده و برخلاف نظام تفتیشی است که منجر به شیوه سلسله‌مراتبی میان دادسرا و پلیس شده است. مولفه‌های مدل شبکه‌ای عبارتند از: اختیارات گسترده و آغازین پلیس، اختیارات محدود و ثانویه دادسرا و روابط افقی پلیس و دادسرا. به نظر می‌رسد این مدل روابط به مثابه یک موجود پویاست و از ظرفیت قابل توجهی برای تطبیق با محیط پیرامون برخوردار است و می‌توان از ظرفیت‌های آن برای بهبود مدل روابط سلسله‌مراتبی نیز بهره برد.

Study of the Network Relation Model between the Prosecution Service and the Police in the Criminal Process

The relationship between the prosecution service and the police is one of the most effective relationships between social institutions in crime management. These relations follow the distinctive models in accordance with the ruling system (accusatorial or inquisitorial). The accusatorial system has governed the network model of prosecution service and police relations. This paper deals with the descriptiveanalytical method to introduce the network model, components of the network relations model of the prosecution service and the police and ultimately criticizes it. This relationship is based on a type of interoperability and network linkage, and is contrary to the inquisitorial system that has led to a hierarchical approach between the prosecution service and the police. This study will provide an introduction to the feasibility of developing the components of this model to the police and prosecution service relations in Iran’s criminal justice system and to improve the governing model.
