تجاوز جنسی و تعارض جنسیتی

نگرش‌های زبانی و فرهنگی به پدیده تجاوز جنسی سبب شده این پدیده به مثابه یک عنوان مجرمانه واقعی در نظام حقوقی ایران شکل نگیرد. عنوان‌های مجرمانه پس از قلمرو سرزنش‌پذیری، با عنوانی جدا، وارد حیطه قانونگذاری شده و با دیدگاهی ویژه، در فرآیند قضایی نمود می‌یابند. تجاوزجنسی از این فرآیند مرحله‌ای دور افتاده و در همان گام نخست یعنی سرزنش‌پذیری با چالش‌هایی همراه است که همین چالش‌ها، در قلمرو قانونگذاری نیز مشاهده می‌شود. نیروی واژگانی زبان فارسی در مفهوم بخشی به تجاوزجنسی، کم و ارزش‌های مورد حمایت در قبال این پدیده، زیاد است. دلیل بنیادین آن، تعارض جنسیتی است. تعارض جنسیتی در این نوشتار مفهومی عام در قبال رویکردهای تعارض‌گونه اجتماعی است.  نگرش‌های مختلفی که از تعارض جنسیتی صورت گرفته باعث شده تا ساخت حقوقی تجاوزجنسی در نظام حقوقی ایران شکل نگیرد و پی آمدهایی همچون رفتارهای خشن جنسی و پیوندهای جنسی سلطه گرایانه به دنبال داشته است.

Sexual Assault and Gender Conflict

Linguistic and cultural attitudes to social and religious approaches to the phenomenon of sexual assault causing this phenomenon as a real criminal with specific constituent elements is not in Iran’s legal system. Criminal titles after the domain of blaming, with a separate title, enter into a legal area and with a special view, appear in the judicial process. The rape of this process is a farreaching process and, at the very first step, it is blamed on the challenges that these challenges face in the legislative sphere. The lexical force of the Persian language is high in the sense of being part of the rape, the low level and the values supported by this phenomenon. The fundamental reason for this is gender conflict. Gender conflict in this paper is a general conception of socialconflict approaches. Due to various genderbased attitudes, the legal process of rape in Iran’s legal system has not been established and has resulted in violent sexual behaviors and sexual orientation.
