بررسی ابعاد و نقش مالکیت فکری در فرایند نوآوری باز با تاکید بر راهبردهای موجود

از دهه‌های گذشته نوعی از نوآوری در حال استفاده و رشد است که از آن با عنوان «نوآوری باز» یاد می‌شود. نوآوری باز مفهومی در مقابل نوآوری بسته است که بر استفاده از منابعی خارج از سازمان برای سرعت بخشیدن به نوآوری، کاهش خطرات و افزایش بازده اشاره می‌کند. در این نوع از نوآوری که فعالان متعدد با منافع ناهمگون به تبادل ایده‌ها، دانش و فناوری می‌پردازند یکی از موضوعات بحث‌برانگیز نقش و جایگاه مالکیت فکری می‌باشد. مسئله اصلی آن است که آیا اصول مالکیت فکری نوآوری باز را تشویق می‌کند یا مانعی در جهت آن است؟ و اگر مالکیت فکری نقشی موثر در این فرآیند دارد چگونه و با چه راهکاری قادر به ایفای نقش خود خواهد بود؟ در این مقاله با روش توصیفی تحلیلی نشان داده می‌شود که باوجود نظریه‌ها و استدلال‌های مختلف و مخالف، یک نظام مالکیت فکری قوی می‌تواند نوآوری باز را تسهیل کند. لیکن در حال حاضر به دلیل نواقص و یا خلاهای قانونی در زمینه مالکیت فکریِ نوآوری باز لازم است از روش‌های جایگزینی استفاده گردد که از میان راهکارهای موجود، مدل مجوزِ ثبت اختراعِ دفاعی می‌تواند تضمین بیشتری را برای جوامع نوآور باز فراهم آورد.

Investigating Dimensions and Role of Intellectual Property in Open Innovation Process Emphasizing on Available Procedures

For decades, a kind of innovation has been applied and growing, referred to as open innovation. Open innovation is a concept in contrast to closed innovation, which refers to the use of outside resources to accelerate innovation, reduce risks and increase efficiency. In this type of innovation where multiple actors exchange ideas, knowledge and technology with heterogeneous interests, one of the most controversial issues is the role and place of intellectual property. The key question is whether intellectual property principles encourage open innovation or hinder it? And if intellectual property play an effective role in this process, then how will it be able to play its role? In this paper, it is shown by a descriptiveanalytical approach that despite different and opposing theories and arguments, a strong intellectual property system can facilitate open innovation. However, due to the shortcomings or legal gaps in open innovation’s intellectual property, it is necessary to use alternative methods that amongst available approaches, defense invention patent model can provide more assurance for open innovation communities.
