تهدیدهای پیش روی اموال فکری و نحوه مقابله با آنها

هرچند اموال فکری مانند هر مال دیگری در معرض تهدیدات و مخاطرات مختلف قرار دارند، ولی واقعیت این است که سایه تهدیدات حاکم بر این اموال در مقایسه با اموال دیگر بیشتر، گسترده تر و عمیق تر است. ماهیت غیر ملموس، تکثیر ساده و کم هزینه، رواج وسایل ارتباطی جهانی مانند اینترنت و از همه مهمتر تحصیل سود بالا از دلایل نقض گسترده این اموال بوده و به آن جذابیت بیشتری می بخشد.با توجه به گستردگی این تهدیدات و آثار زیانبار آنها بر شئون مختلف جامعه از قبیل اقتصاد، سلامت، امنیت و فرهنگ؛ تحلیل تهدیدات عارض بر اموال فکری و نحوه مواجهه با آنها ضروری به نظر می رسد. از این رو، مقاله حاضر با تبیین دامنه و آثار زیانبار تهدیدات، دسته بندی آنها در سه گروه تهدیدهای عینی، تهدیدهای ذهنی و تهدیدهای ناشی از سیاستها و سازوکارهای ناظر به اموال فکری، راهکارهای مقابله با تهدیدات پیش روی اموال فکری را تحلیل می کند.واژه های کلیدی: اموال فکری تهدیدهای عینی تهدیدهای ذهنی تهدیدهای ناشی از سیاست ها و سازوکارهای اموال فکری

The Threats Facing Intellectual Properties and Ways Confronting With Them

Though intellectual properties, like any other properties, are subject to various threats and dangers, but reality is that the shadow of threats to these properties is wider and deeper than other properties. The intangible nature, the simple and low cost of reproduction, the prevalence of universal communication devices, such as the Internet, and most importantly earning highprofit are reasons for the widespread violation of these properties and makes it more attractive.Considering the extent of these threats and their harmful effects on different aspects of society such as economy, health, security and culture, analysis of threats to intellectual property and how to deal with them seems necessary.Hence, the present paper through analyzing the scope and effects of threats, categorizing them into three groups of objective threats, mental threats and threats arising from intellectual property policies and mechanisms, analyzes ways confronting with threats facing intellectual property.Key words: Intellectual Property Objective Threats Mental ThreatsThreats Arising from Intellectual Property Policies and Mechanisms
