چالش‌ های دولت ایران در برابر حقوق کودکان کار با توجه به حقوق بین الملل

زمینه و هدف: حقوق کودکان از مصادیق ویژه‌ی حقوق بشر محسوب می‌شود، بنابراین نادیده گرفتن آن منجر به نقض بارز حقوق بشر از جنبه‌ی بین المللی و هم چنین دارای عواقب جبران ناپذیر در داخل کشور می‌باشد. حل پدیده ی کار کودک امکانپذیر نیست مگر بااتحاد نهادهای ذی ربط، ضمانت اجرای موثر و مستمر همراه با یکسان سازی قواعد حقوقی. روش: این پژوهش کیفی و به لحاظ هدف، کاربردی و از نظرگردآوری اطلاعات به روش اسنادی و مطالعه اسناد بین المللی، انجام شده و با روش توصیفی–تحلیلی به بررسی چالش های کودکان کار در ایران با نگاهی بر حقوق بین الملل برآمده است. یافته‌ها و نتایج: عدم هماهنگی نهادهای مسئول، نبود بودجه ی کافی برای اجرای طرح های مبارزه با کار کودک، همراه با رکود اقتصادی ناشی از بیماری کویید 19 و اثرات ناشی از آن از مهم ترین علل حل نشدن کار کودک در داخل است. ابهام وتناقضات در قوانین داخلی در کنار پیوستن به معاهدات بین المللی این معضل را پیچیده تر نموده است.تصویب قانون حمایت از حقوق کودکان و نوجوانان مصوب 1399 در ایران جهت هماهنگی بیشتر با قوانین بین المللی گام مثبتی بوده است، لیکن دراین قانون بدون آن که سن کودک در تعاریف قبلی تغییری کرده باشد، افراد زیر 18 سال در موارد تصریح شده مورد حمایت قرار گرفته اند. بنابراین هم چنان در موارد خارج از شمول این قانون کودکان مورد حمایت لازم قرار نمی‌گیرند. استمرار اصلاح قوانین برای حمایت همه جانبه ضروری است.

field and aims: children’s rights are considered as special examples of human rights, so ignoring this issue leads to violation of human rights from the international aspect and also has irreparable consequences inside the country. eliminating child labor is not possible except with the union of relevant institutions, the guarantee of effective and continuous legal implementation along with the unification of legal rules.method: this is a qualitative and applied research in terms of purpose, and in terms of collecting information by documentary method and studying international documents, sources related to the subject and the obtained information has been analyzed descriptively-analytically method to examine the challenges of child labor in iran with a view on international law. findings and results: the lack of coordination of the responsible institutions and insufficient budget, along with the economic recession caused by covid-19 and its effects, are among the most important reasons for child labor not being solved in the country. ambiguity and contradictions in domestic laws by joining international treaties have made this problem more complicated.the approval of the law on the protection of children and adolescent rights in 2019 in iran has been a positive step for coordination with international laws, but in this law, without changing the age of the child in the previous definitions, people under the 18 are protected in specified cases. therefore, in cases outside the scope of this law, children do not receive the necessary support. continued reform of laws is necessary for comprehensive protection.
