تضمین حقوق شهروندی در پرتو شوراهای اسلامی با نگاهی به اسناد حقوق بشری

حمایت از حقوق شهروندی در ارکان مختلف سیستم های قانونگذاری و همچنین اجرای آن به عنوان یک اصل مورد پذیرش قرار گرفته است. از این رو به نظر می رسد در حوزه مقررات حاکم بر شوراهای اسلامی شهر و روستا نیز از چارچوب های مبتنی بر حمایت از حقوق شهروندی استفاده می شود. حقوق شهروندی هم در مرحله ایجاد و هم در مرحله اجرا باید در پرتو حقوق شهروندی و حمایت از آن باشد. در این مقاله به دنبال ایجاد ساز کاری برای تطبیق مبانی حقوق شهروندی با کارکردهای شوراهای اسلامی هستیم. همچنین در این خصوص ضمانت اجراهای مربوط به حمایت از حقوق شهروندی در کارکردهای شوراهای اسلامی شهر و روستا مورد ارزیابی و تحلیل قرار خواهد گرفت. روش انجام این تحقیق به صورت توصیفی و تحلیلی می باشد و همچنین روش گردآوری اطلاعات به صورت کتابخانه ای است. روش انجام این تحقیق به صورت توصیفی و تحلیلی می باشد و همچنین روش گردآوری اطلاعات به صورت کتابخانه ای است.

guaranteeing citizenship rights in the light of islamic councils with a look at human rights documents

field and aims: protection of citizen's rights has been accepted as a principle in various elements of legislative systems as well as its implementation. therefore, it seems that principles based on the protection of citizen's rights are also used in the field of regulations governing islamic city and village councils. citizenship rights should be in the light of citizenship rights and its protection both in the creation phase and in the implementation phase.method: the present research was carried out using a descriptive analytical method.finding and conclusion: human rights documents can undoubtedly be considered as one of the important sources of citizenship rights. in other words, by joining the human rights documents, governments commit to align their domestic regulations with their international obligations, and based on this, drafting regulations related to the right of citizenship is a part of this process.councils can play a significant and important role in the realization of citizens' rights by providing a platform for citizens'participation in the administration of affairs. considering the role of citizens in the city council elections, it seems that the right of citizens is respected in the councils when they have the principle of voluntary participation in the elections.
