جهانی شدن موازین حقوق بشر و آثار آن در نظام حقوقی ایران

زمینه و هدف: تاثیر قوانین بین‌المللی بر نظام هنجاری حقوق داخلی کشورها به خصوص در عرصه حقوق از جمله مسائل میان‌رشته‌ای و مهمی است که امروزه محل بحث و چالش است. در نظام حقوق داخلی موانعی نظیر اصالت دادن به نسبت‌گرایی فرهنگی و طرفداری از فرهنگ و نظام خاص حقوقی مانعی در این راه یعنی نفوذ قوانین و مقررات بین‌المللی بر عرصه حقوق داخلی می‌باشد. بخش‌های مختلف یک نظام منسجم حقوقی و قضایی همچنان که در حقوق داخلی وجود دارند در نظام حقوق بین‌الملل نیز به‌گونه‌ای دیگر قابل‌مشاهده‌اند. در نظام حقوقی ایران بسیاری از ارزش‌های حقوق بین‌الملل از سال‌های دور تاکنون بر تصویب و تغییر قوانین شکلی و ماهوی موثر بوده است.روش: روش پژوهش به‌صورت توصیفی- تحلیلی می‌باشد.یافته‌ها و نتایج: پرسش اصلی تحقیق آن است که جهانی شدن حقوق بشر چه آثاری در نظام حقوقی ایران دارد؟ فرضیه نگارنده آن است که مولفه‌های حقوق بشری به عنوان نُرم‌ها یا هنجارهای حقوق بین‌الملل شکلی‌ جهانی یافته و اگر نه قوانین اساسی، اما نظام داخلی و به ویژه حقوق بشر کشورها را متاثر از خود ساخته‌اند. در مجموع می‌توان گفت نظام‌های حقوق داخلی در مقابل پاره‌ای از ارزش‌ها و هنجارهای بین‌المللی چاره‌ای جز فروآوردن سر تسلیم ندارند و در مقابل دسته‌ای دیگر حق الحاق و پیوستن به معاهده خاص را دارند.

the globalization of human rights standards and its effects in iran’s legal system

field and aims: the impact of international laws on the normative system of internal laws of countries, especially in the field of law, is one of the interdisciplinary and important issues that is the subject of debate and challenge today. in the internal legal system, obstacles such as giving authenticity to cultural relativism and favoring a specific culture and legal system are an obstacle in this way, that is, the influence of international laws and regulations on the field of domestic law. different parts of a coherent legal and judicial system, as they exist in internal law, can also be seen in the international law system in a different way. in iran’s legal system, many values of international law have been effective on the approval and change of procedural and substantive laws.method: the research method is descriptive and analytical.finding and conclusion: the main research question is what are the effects of the globalization of human rights on iran’s legal system? the author’s hypothesis is that the components of human rights have found a global form as norms of international law. and although it could not affect the  constitution it has affected the internal system and especially the human rights of the countries it has affected the internal system and especially the human rights of the countries.
