بررسی فقهی سرمایه گذاری خارجی و محیط زیست و مناسبات حقوقی آنها با یکدیگر

زمینه و هدف: با توجه به جامعیت دین اسلام و ظرفیت احکام دینی و فقهی در خصوص امکان صدور احکام متناسب و با تاثیرپذیری از مقتضیات زمان و مکان در زمینه مسائل مورد نیاز جامعه و حتی مسائل مستحدثه و انطباق احکام دینی امروزه ضروری است. موضوع سرمایه‌گذاری خارجی بیش‌ از پیش مورد مطالعه قرار گیرد؛ به همین دلیل در این پژوهش تلاش و هدف این است تا در حد امکان که به جایز بودن فعالیت سرمایه‌گذاری خارجی و عدم تخریب محیط زیست با توجه به قواعد فقهی و اسلامی استناد می‌شود؛ به تاثیر سرمایه‌گذاری خارجی در تخریب محیط زیست که با اصول فقهی و دینی کشور ما مخالف است نیز پرداخته شود؛ بنابراین ضرورت انجام این تحقیق نیز ارائه راهکارهای حقوقی لازم برای کاهش و عدم اثرات منفی سرمایه‌گذاری خارجی بر محیط زیست است تا از این طریق گامی موثر در جهت مدیریت سرمایه‌گذاری خارجی با حفظ ملاحظات زیست‌محیطی برداشته شود.روش: پژوهش حاضر به روش توصیفی- تحلیلی انجام شده است.یافته‌ها و نتایج: با توجه به اهمیت سرمایه‌های خارجی و تاثیر آن بر وضعیت محیط زیست در دهه‌های اخیر بر آن شدیم، ابتدا موضع شریعت اسلام در مورد سرمایه‌گذاری خارجی و همچنین تحولات حادث در محیط زیست با استناد به منابع فقهی مورد مداقه قرار دهیم و سپس تاثیر سرمایه‌گذاری خارجی را در تخریب محیط زیست و راهکارهای پیشنهادی مورد تبیین و تحلیل حقوقی قرار دهیم تا از این طریق گامی موثر در جهت تعادل حفظ محیط زیست و جریان سرمایه‌گذاری خارجی با توجه به مبانی فقهی و حقوقی برای کشورمان برداشته شود.

jurisprudential study of foreign investment and the environment and their legal relations with each other

background and aim: in this research, the aim and goal is to refer to the permissibility of foreign investment activities and non-destruction of the environment according to the jurisprudential and islamic rules; the effect of foreign investment in the destruction of the environment, which is contrary to the jurisprudential and religious principles of our country should also be addressed; therefore, it is necessary to conduct this research to provide the necessary legal solutions to reduce and eliminate the negative effects of foreign investment on the environment, so that an effective step can be taken to manage foreign investment while maintaining environmental considerations.method: in this research, analytical and descriptive methods have been used.findings and results: considering the importance of foreign investment and its impact on the environment in recent decades, we decided to first examine the position of islamic law on foreign investment and developments in the environment with reference to jurisprudential sources and then explain and analyze the impact of foreign investment on environmental degradation and the proposed solutions in order to take an effective step towards balancing the environment and the flow of foreign investment according to the jurisprudential and legal principles for our country.
