تحلیل حقوقی شرایط نامزدهای ریاست‌جمهوری با تاکید بر تبیین شرایط «رجال مذهبی و سیاسی»

گرچه شرایط نامزدهای انتخابات ریاست‌جمهوری در اصل (115) قانون اساسی تصریح شده است، اما عدم ذکر مصادیق، مبهم بودن بعضی شرایط نامزدها، لزوم جامه عمل پوشاندن به سیاست‌های کلی انتخابات و ضرورت مبذولیت اهتمام حداکثری در تعریف شرایط نامزدهای ریاست‌جمهوری به خصوص شرایط مربوط به رجل مذهبی و سیاسی برای نامزدها توسط شورای نگهبان، این زمینه را ایجاد کرد که شرایط نامزدهای ریاست‌جمهوری در یک برهه‌ زمانی خاص، توجه عموم مردم و سیاسیون را به خود معطوف کند. در مصوبه‌ شورای نگهبان، برخی از شرایط نامزدهای انتخابات ریاست‌جمهوری عینی‌تر شده، به‌نحوی‌که شناخت نامزدهای بالقوه ملموس‌تر شده است. با‌این‌حال تبیین حقوقی شرایط نامزدهای ریاست‌جمهوری علاوه‌بر اینکه مصادیق را شفاف‌تر جلوه می‌دهد سنجه‌های شناخت نامزدهای ریاست‌جمهوری از سایرین را نیز به نحوی تبیین می‌کند تا از ابهامات سابق به دور بوده و برای عموم مردم قابل تشخیص باشد. تلقی شدن رجل مذهبی و سیاسی برای نامزدهای انتخابات ریاست‌جمهوری نیاز به مقدماتی دارد تا شرایط مورد نظر برای هر نامزد توسط شورای نگهبان احراز شود. تبیین شرایط رجل مذهبی و سیاسی علاوه‌بر اینکه رویه و طریقیت رسیدگی شورای نگهبان به صلاحیت داوطلبان را مشخص می‌کند، ملاک‌های افراد واجد شرایط را نیز برای عموم مردم شفاف‌تر می‌کند. با‌این‌حال چون مصوبه یاد شده شرایط نامزدهای انتخابات ریاست‌جمهوری را جزئی‌تر بیان می‌کند، کمک شایانی به شفاف‌تر شدن فرایند انتخابات می‌کند. در این پژوهش ابتدا شرایط نامزدهای انتخابات ریاست‌جمهوری به‌طور اجمالی ذکر شده، سپس شرط رجل مذهبی و سیاسی بودن نامزدها مورد بررسی قرار گرفته و در نهایت مصوبه‌ شورای نگهبان مورد نقد و بررسی واقع شده است.

legal analysis of presidential candidates’ eligibility emphasizing clarification conditions of the religious and political figures (rijal)

although the eligibility of presidential candidates is specified in article 115 of the constitution, not mentioning cases, the ambiguity of some conditions of candidates, the requirement to implement general election policies, and the requirement to utmost minding in defining the conditions of the presidential candidates, especially the guardian council’s conditions about being a religious and political figure, created a situation for the presidential candidates to attract the attention of the public and politicians at a particular time. in the guardian council resolution, some conditions of the presidential candidates are more objective, so that identifying potential candidates has become more tangible. however, the legal explanation of the eligibility of the presidential candidates, in addition to making the cases clearer, theorizes the criteria for recognizing the presidential candidates from others in a way being far from the previous ambiguities and being diagnosed by the general public. being a perceived religious and political figure candidate requires a prerequisite for achieving the desired conditions to approve guardian council’s oversight. clarifying the conditions of religious and political status, in addition to specifying the procedures and methods of the guardian council’s examination of the qualifications of candidates, makes the criteria of qualified candidates more transparent for the general public. however, since the aforementioned resolution describes the conditions of presidential candidates in more detail, it supports making the election process more transparent. in this study, in the beginning, the conditions of the presidential candidates are briefly mentioned, then the condition of being a political and religious figure was examined and in conclusion, the resolution of the guardian council was reviewed.
