چکیده
|
برگزاری انتخابات برای گزینش تصمیمسازان در سطوح مختلف ملی و منطقهای به راهکاری یگانه برای تحقق حاکمیت ملی و مردمسالاری جهت تمشیت امور کلان هر جامعه و مدیریت تضادها و اختلاف سلایق اقشار گوناگون آن تبدیل شده است. به لحاظ حقوقی و فنی، امر حساس «حوزهبندی انتخاباتی» که بهمعنای تقسیم سرزمین و جمعیت یک کشور به حوزههای انتخاباتی مختلف برای ایجاد تناسب بین شمار نمایندگان و جمعیت کشور است، مقدمهای مهم و ضروری برای نیل به دستاورد پیشگفته است. در این مطالعه توصیفی تحلیلی که براساس دادههای اسنادی و کتابخانهای به رشته تحریر درآمده، نگارندگان به این پرسش پاسخ خواهند گفت که «مبانی، معیارها و اصول حقوقی حاکم بر حوزهبندی انتخاباتی چیست و چه بازتابی در نظام حقوقی ایران دارد؟». با تدقیق در جنبههای گوناگون موضوع، میتوان امانت و حقالناس بودن آرای مردم و همچنین آزاد و منصفانه برگزار شدن انتخابات را مبانی دینی و عرفی حوزهبندی صحیح شناسایی کرد؛ چنانچه با معیارهایی همانند جمعیت برابر، مرز و اندازه جغرافیایی متناسب و در نظر داشتن جوامع همسود و هممنفعت سازگاری یابد. در پرتو رعایت اصولی حقوقی همچون استقلال و بیطرفی مقام تصمیمگیر در حوزهبندی انتخاباتی، برابری اعتبار و ارزش آرای شهروندان، نمایندگی، عدم تبعیض، شفافیت فرایند حوزهبندی و مشارکت موثر در انتخابات، زمینه برگزاری انتخاباتی سالم و عادلانه را فراهم خواهد ساخت. بهطوریکه راهبردهای مذکور در اسناد بالادستی نظام جمهوری اسلامی ایران نیز هدفی جز این ندارند که در صورت حرکت شتابانتر در مسیر تحقق این راهکارها نقاط ضعف موجود در عرصه عمل همچون حوزهبندیهای جانبدارانه نیز مرتفع خواهند شد.

Abstract
|
Holding elections in order to elect decisionmakers at different national and regional levels has become the only method in which to realize national sovereignty and democracy. It is also fundamental in being able to manage a society’s macro affairs and in controlling the conflicts andDisparities of its different classes. Legally and technically, the crucial issue of “electoral redistricting”, which means dividing a country’s territory and population into different constituencies in order to balance the number of representatives and population of the country,is an important and necessary prerequisite for achieving the aforementioned goal. In this descriptiveanalytical study, which was based on documentary and library data, the authors answer the following question: “What are the fundamentals, criteria and legal principles governing electoral redistricting and how do they influence the Iranian legal system?”By looking at the various aspects of this issue, one can identify, the religious and customary principles of a proper redistricting is based on the reliability of people’s votes and holding a fair and free election. It must be noted, a fair and free election observes criteria such as equal population, appropriate boundaries and geographical size and takes commoninterest communities into consideration. In addition, a fair and free election must abide by a number of legal principles such as, the independence and impartiality of the decisionmaking authority in charge of electoral redistricting, equality of the credit and value attributed to citizens’ votes, equal representation, nondiscrimination, transparency of the redistricting process and effective participation.The above criteria and strategies have been stipulated in important documents within the Iranian electoral and voting system and if the Iranian government were to pursue these goals and aim to achieve them in a much shorter time span, problems such as gerrymandering can to some extent be eradicated.
