مجوززدایی بهمثابه مقرراتزدایی: تحلیل مفهومی مقرراتزدایی در ایران

چکیده
|
صدور مجوزها بهعنوان یکی از موانع اصلی کسبوکارها مطرح شده است. آنچه این مقاله بر آن متمرکز است، ضرورت تفکیک بین «مقرراتزدایی» بهمعنای عام، از «مجوززدایی» بهمعنای خاص است. با وجود اینکه «مجوززدایی»، بخشی از «مقرراتزدایی» محسوب میشود و درواقع، مجوززدایی پیشنیاز مقرراتزدایی محسوب میشود، اما حذف یا لغو قوانین و مقررات مخل و مزاحم تولید و کسبوکار را باید از حذف مجوزهای دستوپاگیر و مخل برای کسبوکار، تفکیک کرد. مقوله مقرراتزدایی، نیازمند ورود جدی مجلس و دولت برای شناسایی قوانین و مقررات مخل و مزاحم و بهویژه انجام فرایندها و رویههای «تدوین و تنقیح قوانین و مقررات» و «ارزیابی تاثیرات قوانین و مقررات» است. اما مقوله مجوززدایی، بهطور خاص نیازمند ورود دولت از طریق نهادی ستادی و عالی و همچنین هریک از وزارتخانهها برای لغو و حذف مجوزهای دستوپاگیر، رویههای ضدرقابتی و رفتارهای مخل محیط کسبوکار است. برخلاف شناسایی و حذف قوانین و مقررات مخل کسبوکار، مجوززدایی با توجه به مختصات بوروکراسی امروز ایران، مستلزم اصلاح رویهها و ترتیبات نظام اداری است که بسیاری از آنها، ناشی از رفتارهای خلاف قوانین و مقررات و خودسرانه و بینیاز از اقدامهای تقنینی است. توجه بیش از حد به نظام قانونی و تصویب مکرر قوانین و مقررات، سوای آنکه به پدیده آسیبرسان تورم قوانین انجامیده است، سبب نادیده انگاشتن ضعفها و نقصانهای نظام بوروکراسی شده است.

Delicensing is Tantamount to Deregulation: Conceptual Analysis of Deregulation in Iran

Abstract
|
The issuance of licenses is known to be one of the main barriers to entry for businesses. This article focuses on the necessity to distinguish between deregulation and delicensing. Although delicensing is a part of deregulation and in fact delicensing is required before deregulation is carried out, the removal or amendment of laws and regulations, which are detrimental to production and business, should be set apart from the removal of disruptive business permissions. For deregulation, the parliament and the government are required to interfere and identify disruptive laws and regulations, and they are also required to agree to the implementation of procedures for Codificaton and Regulatory Impact Assessment (RIA). However, delicensing in particular, requires the government’s interference through institutions, headquarters, and ministries, in order to abolish and remove licensors, anticompetitive practices, and unfavorable conducts in the business environment. Due to the bureaucratic practices which exist in Iran today, the layout and the procedures within the administrative system need to be amended in order for delicensing to be carried out justly. Many of the procedures within the administrative system are as a result of the violation of laws and regulations and are arbitrary measures. The excessive attention paid to the legal system and the repeated approval of laws and regulations have led to the weaknesses and flaws of the bureaucratic system being overlooked.
