مدل لایحه حمایت از انتشارات و کتابخانه‌ها با استفاده از تنقیح قوانین: رویکرد نظریه داده‌بنیاد

پژوهش حاضر در نظر دارد از طریق راهکار تنقیح قوانین و مقرراتو پایش در حوزه کتاب، انتشارات و اطلاع‌رسانی، الگو و مفاد لایحه قانونی حمایت از انتشارات و کتابخانه‌ها را ارائه کند. این پژوهش برمبنای نظریه داده‌بنیاد و با هدف توسعه‌ای کاربردی انجام شده است.  روش پژوهش ترکیبی از روش‌ سندی، دلفی و نظریه داده‌بنیاد است. تعداد 75 عنوان با موضوع انتشارات و 185عنوان با موضوع کتابخانه‌ها (به تفکیک کتابخانه‌ها) شناسایی و وضعیت تنقیحی هریک مشخص شد. با تجزیه و تحلیل داده‌های پرسشنامه، 15 خلا قانونی احصا شد که موضوع ایجاد و تقویت کتابخانه‌های آموزشگاهی در مدارس از مهم‌ترین آنها بود. با استفاده از روش داده‌بنیاد پس از پیاده‌سازی مصاحبه‌ها و بررسی سطر به سطر، از 86 مفهومباز و کلیدی، 52 مفهوم محوری ساخته شد، سپس در 12 مقوله انتخابی ناشران، نشر، مولفان، راهبردهای کلان، ساختار و تشکیلات، کتابداران، کتابخانه‌های عمومی، کتابخانه‌های آموزشگاهی و دانشگاهی، منابع و اعتبارات، مجموعه‌سازی و امور قضایی و جزایی دسته‌بندی شد. الگوی کدگذاری محوری لایحه شامل شرایط علی، شرایط مداخله‌گر، شرایط زمینه‌ای، راهبردها و پیامدها ترسیم و درنهایت با شناسایی کامل خلاها و نیازهای قانونی، لایحه پیشنهادی حمایت از انتشارات و کتابخانه‌ها تهیه شد که در این لایحه، متناظر با هریک از خلاهای احصا شده، ماده قانونی مرتبط پیشنهاد شده است.

Model Legal Bill for Publications and Libraries Supplemented by Incorporation of Laws and the Grounded Theory Approach

The present study intends to introduce the model of the ‘Publications and Libraries Bill’ by monitoring and compiling the laws and regulations in this field. This research is conducted using the Grounded Theory Approach and aims to further develop its application. DevelopmentalApplied Data and a Combination Method that integrates Documentary, Delphi and Grounded methods was used. 75 studies based on the subject of publication and 185 studies based on the subject of libraries (various kinds of libraries) were found and identified. Then, each subset status was determined. By analyzing the data of the questionnaire, 15 legal vacuums were found and identified.  The most important, was the requirement to establish and strengthen school libraries in schools. After obtaining interviews and reviewing them word by word and using the ContentAnalysis Method, 52 concepts were extracted from 86 key concepts. They were then grouped into 12 categories; these were: publishers, publishing, authors, macro strategies, structure and organization, librarians, public and academic libraries, resources and credits, collection and judicial affairs and penalties. Using the methods of Grounded Theory, conceptualization and categorization, conceptual relationships and isolating common features between open identifiers, concepts and categories were identified based on the similarities found among them. As a result, the final model was based on three categories: conceptual, qualitative, and component components. The pivotal coding model of the bill included the causal conditions, intervening conditions, ground conditions and strategies and outcomes, and then finally, with full identification of the gaps and legal requirements, a proposed bill of support for publications and libraries was prepared.
