گفتمان سیاست‌جنایی در رساله‌ی حقوق امام سجاد(ع)؛ بازشناسی گفتمان کیفری شریعت

نظریه‌ی کیفری شریعت در شمار اثرگذارترین منابع قانونگذاری کیفری در ایران قرار دارد. این اثرگذاری، تنها به واسطه‌ی آمیختگی ساختار قدرت با نظریه‌ی سیاسی مذهب در ایران نیست. تاثیرگذاری نظام کیفری شریعت بر قانونگذاری کیفری در ایران بیش از هر چیز ناشی از این واقعیت است که ارزش‌ها و هنجارهای مذهبی در جریان انباشت تاریخی مبدل به بخشی جدایی‌ناپذیر از خرده‌نظام فرهنگی در جامعه‌ی ما شده‌اند. به واسطه‌ی این وابستگی گسست‌ناپذیر، قرائتی که از نظریه‌ی کیفری مذهب ارائه می‌گردد؛ نقشی بسیار مهم در سیاست‌گذاری کیفری ایفا می‌کند. در کنار سایر متون مرسوم فقه کیفری، رساله‌ی حقوق امام سجاد(ع) نیز در شمار منابعی است که می‌توان از دل آن نشانه‌هایی از گفتمان کیفری شریعت را جستجو کرد. رساله‌ی حقوق، نظامی فراگیر از تکالیف و حقوق متقابل را به تصویر می‌کشد که تمامی شئونات حیات مادی و معنوی انسان را در بر گرفته‌اند. بازشناسی گفتمان این نظام در هم‌آمیخته از حقوق و تکالیف، نقشی مهم در شناخت واقعی نظریه‌ی کیفری شریعت ایفا خواهد کرد. تلاش پژوهش حاضر آن است تا با تکیه بر روش تحقیق «تحلیل محتوا»، زمینه را برای شناسایی گفتمان کیفری شریعت از بطن متون رساله‌ی حقوق فراهم آورد. ره آورد شناسایی این گفتمان، دگرگونی قرائت‌ها از نظریه‌ی کیفری مذهب خواهد بود.

Penal Policy Discourse from the Perspective of Imam Sajjad’s Treaties of Rights Risalat alHuquq; Recognition of Sharia Penal Policy Discourse

Penal policy of Sharia has important role in the Iranian penal legislation. This impact is not just because of the deep relationship between Sharia and political structure in our society. The effectiveness of Sharia penal policy on the Iranian penal legislation process is originated from the fact that religious norms and values in the historical accumulation process have become an integral part of cultural subsystem in our society. Due to deep relationship between Islamic norms and values and cultural subsystems, the Islamic penal policy has deep and extensive impacts on criminalization as well as penalization in our criminal policy discourse.Imam Sajjad’s Treaties of Rights is one of rich sources that we can realize the penal policy discourse of Sharia through scrutinizing it. His Treaties of Rights is a coherent system of rights and duties which cover all material and spiritual aspects of life. Recognition of penal policy of this book can help us understanding the penal policy discourse of Sharia. Indeed, we can find out the penal policy of Sharia through the identification of Imam Sajjad’s Treaties of Rights on penal policy discourse.
