متفکران و کنشگران عهد مشروطیت در ایران و مسئلۀ حقوق اساسی ملت

هدف از این مقاله بررسی مفهوم حقوق و آزادی‌های اساسی ذیل مفهوم عدالت، نزد متفکران مشروطه است. مقاله بر آن بوده که با روش تحلیل تاریخی، تعریف دقیقی از حقوق اساسی نزد بیش از سی روحانی و روشنفکر دوران مشروطه عرضه دارد و تلاش کند دسته‌بندی مناسبی از نوع مواجهۀ هریک از ایشان نسبت‌به حقوق و آزادی‌ها ارائه دهد و از دسته‌بندی‌های دوگانه تن زند. چارچوب مفهومی و نظری موردبررسی، نحوۀ شکل‌گیری سوژۀ مدرن نزد کانت و رالز؛ و ازطرفی دسته‌بندی‌های موجود از حقوق، بوده است. درنهایت طیفی ارائه شد که در دستۀ اول آن باور به اینکه «آزادی باعث نشر زنادقه و مخالفت با اسلام است»؛ در دستۀ دوم «باورمندان به حقوق سیاسی یا حقوق شاه و رعیت، یا مردم و مسئولان»؛ در دستۀ سوم «حقوق اقتصادی و اجتماعی برای قوام بخشیدن به جامعه»؛ در دستۀ چهارم «باورمندان به حقوق شخصی و سیاسی» و در دستۀ پنجم «حقوق اساسی و آزادی‌های عمومی به‌عنوان حق شهروندی» وجود دارد.

thinkers and activists of the constitutional era in iran and the issue of the fundamental rights of the nation

the purpose of this article is a historical study of the concept of fundamental rights and freedoms among constitutional thinkers. the article sought to provide a precise definition of rights, by the method of historical analysis, by more than 30 constitutional clerics and intellectuals; and try to offer an appropriate classification of each of their encounters with rights and freedoms. the conceptual and theoretical framework under consideration is how kant and rawls formed the modern subject; on the other hand, the existing categories of rights. eventually, a ranges emerged in which believers believed that freedom causes the spread of heresy and opposition to islam; political rights or the rights of the king and the humans; economic and social rights to consolidate society; personal and political rights and fundamental rights and public freedoms as citizenship rights.
