اثر ایدئولوژی بر نظام نظارت و تعادل در نظام سیاسی جمهوری اسلامی ایران

یکی از ویژگی‌های مهم نظارت بر قدرت سیاسی، متعادل بودن آن است تا از طریق آن مسمی «توقف قدرت با قدرت» به جا آید. در صورت بر هم خوردن تعادل در نظارت، بخشی از قدرت با چیرگی بر سایر نهادها عملاً قدرت سیاسی را از وضع حقوقی خارج می‌سازد. بر این بنیاد، نوشتار حاضر ضمن پذیرش ایدئولوژیک‌بودن نظام جمهوری اسلامی، با بهره‌جویی از روش توصیفی-تحلیلی، مترصد پاسخ به این سوال است که ماهیت خاص نظام جمهوری اسلامی چه تاثیری بر نظام نظارت بر قدرت سیاسی گذاشته است؟ پژوهش پیش رو در این مسیر، با روش اسنادی، گلوگاه‌های قدرت در نظام را کاویده و تقابل نهادهای انتخابی و انتصابی را از لحاظ دارابودن صلاحیت‌های نظارتی و مهم‌تر از آن شیوه اعمال این نوع صلاحیت‌ها تحلیل نموده است. طرفه آن که خصیصه‌های ایدئولوژیک‌بودن سبب آن شده است که توزیع صلاحیت‌های نظارتی در قانون اساسی، تفاسیر بر آمده از آن و همچنین رویه حکمرانی مقامات، کفه ترازوی قدرت سیاسی را به نفع نهادهای انتصابی سنگین کند و در سوی دیگر نهادهای انتخابی توفیق چندانی برای توقف قدرت نهادهای انتصابی نیابند. این امر با به مخاطره کشاندن اصول مهم حقوق عمومی مانند حاکمیت قانون و نظارت بر قدرت، تصویر «جمهوری»بودن نظام را کدر کرده است.

introductionalthough all legal rules seek to provide comfort, public order and justice, but the role of a group of rules in the direction of realizing these triple goals seems to be stronger. aglimpse at the hierarchy of law sources reveals to us the importance of a particular field of law. since the basic rights of citizens are mentioned and protected in the constitutionlaw in every country, the rules of public law play the most important role in the lives of all citizens, because there is no area of the personal and social life of individuals that is not covered by the rules of public law.one of the important issues of public law (and especially constitutional law) is the protection of citizens' rights against the government class. these debates took a newform from the 18th century and with the beginning and rise of the constitutionalism movement, and the subordinates this time in the form of citizens sought to establish their rights against the rulers (who later were considered the representatives of the citizens).from the heart of these movements, after twenty centuries, the dry roots of democracy sprouted new buds and gradually, following the establishment of constitution laws, democracy was recognized as the most logical way of government. democracy in the modern era has conditions that include the wise distribution of power. on this basis, the distribution of power should be in such a way that it is removed from the personal and concentrated form in the hands of one person or a few people and divided among the members of the ruling body that are chosen by the people, and each of them has the power and the means to control the power of the other. have so that no one can encroach on the authority of others or abuse their power, and finally, accordingto the famous words of montesquieu, power must stop power. the clearest meaning of this phrase is that political institutions must have sufficient means to monitor each other.therefore, it is not an exaggeration if we consider supervision as one of the pillars of the democratic system, to the extent that the absence of this important factor in the political system leads to the concentration of power and ultimately the destruction of democracy.the world of humanities has always been a scene of influence and influence of different concepts on each other.
