آسیب شناسی سیاسی – حقوقی مصوبات مرتبط با ورزش و تربیت بدنی در مجلس شورای ملی عهد پهلوی دوم

هدف این پژوهش آسیب شناسی حقوقی - سیاسی احکام و قوانین مرتبط با امور ورزش و تربیت بدنی در عهد پهلوی دوم بر مبنای قانونگذاری خوب است. در اهمیت و ضرورت پژوهش قابل توجه است که نخبگان ایران پس از انقلاب مشروطیت سعی در نهادینه و محدودسازی نظام سیاسی به قانون بودند، این مهم در عرصه های گوناگون از جمله تربیت بدنی و ورزش به عنوان گسترده‌ترین پدپده اجتماعی عصر حاضر در مجالس ادوار پهلوی دوم به چشم می خورد.در دنیای مدرن ورزش مبتنی بر جامعه ، ورزش مبتنی بر نخبگان ، توسعه ورزش به مثابه صنعت، و توسعه ورزش به مثابه ابزار تربیت عامه ، رویکردهای چهار گانه ای هستند که در مدل مول و همکاران، در چهار سطح آموزشی، همگانی و تفریحی، قهرمانی و حرفه ای دسته بندی شده اند. بنابراین این پژوهش با رویکرد کیفی انتقادی در پی بررسی اصل تشریفات تقنینی از اصول قانون گذاری خوب در ضمن تحلیل روند و جهت گیری سیاست های تقنینی عهد پهلوی دوم با تاکید بر مولفه های اصلی توسعه ورزش در دنیای مدرن است . نتایج بدست آمده نشان می دهند که تمام قوانین ورزشی مصوب در عهد پهلوی دوم لایحه محور بوده اند که این روند با وجود انطباق به اصل تشریفات تقنینی احتمالا ناشی از چالش تفکیک قوا و حاکی از حکمرانی مطلقه پهلوی دوم بر نظام قانون گذاری است . این عدم توازن در سیاست تقنینی موضوعه ورزش، سبب عقب ماندگی صنعت ورزش ایران شده است .

PoliticalLegal Pathology of Acts Related to Sports and Physical Education in the national consultative assembly of the Second Pahlavi Era

The purpose of this research is the political legal pathology of the laws related to sports and physical education in the national consultative assembly in the second Pahlavi era based on the theories of the State of Law and good legislation In the modern world, communitybased sports, elitebased sports, the development of sports as an industry, and the development of sports as a means of public education are four approaches in the Mulll et al. this model at four levels: educational, public and recreational, championship and professional Are classified. Therefore, this research with a critical qualitative approach examine the principle of Legislative formalities from the principles of good legislation, while analyzing the trend and orientation of legislative policies from the second Pahlavi era with emphasis on the main components of sports development in the modern world. The results showed that all sports laws adopted in the second Pahlavi era are billoriented, which, despite compliance with the Good Legislation (Legislative formalities (, is probably due to the challenge of separation of powers and indicates the absolute rule of the second Pahlavi in Legislative system. In addition, most of the legislative policies on the subject of sports are about the development of educational, public and recreational and championship sports, and little attention is paid to the development professional sports. This imbalance in the legislative policies of the sport has led to the backwardness of the Iranian sports industry.
