تحلیلی بر حجیت خبر ثقه در موضوعات با تاکید بر دیدگاه سید احمد خوانساری

یکی از مهم‌ترین منابع فقه امامیه، سنت در قالب خبر ثقه بوده و بخش شایان توجهی از آن، ناظر به موضوعات خارجی است؛ ولی مشهور اصولیان، گسترۀ اعتبار خبر ثقه را به احکام محدود می‌دانند و بر این نظرند که اِخبار از موضوعات مربوط به باب بینه است که در آن عدالت و تعدد شهود، اخبار از حس و مشاهده معتبر خواهد بود. از سوی دیگر ظاهر، بلکه صریح فتاوای برخی از دانشیان فقه و اصول، حجیت داشتن خبر ثقه در موضوعات است. در مقالۀ پیش‌رو، قصد داریم با روش تحلیلی و توصیفی به واکاوی فتاوی و ادلۀ موافقان و مخالفان حجیت خبر ثقه در موضوعات فقهی با محوریت دیدگاه سید احمد خوانساری بپردازیم تا این رهگذر، گسترۀ آن را مشخص کند. یافته‌های پژوهش نشان می‌دهد که از دیدگاه موافقان، اعتبار بیّنه، برای اثبات موضوعاتِ متعلق به دعاوی حقوقی و مالی تشریع شده است و حجیت خبر ثقه در سایر موضوعات، بدون اشکال خواهد بود. صاحب جامع‌المدارک نیز با نقد دیدگاه مشهور، شرط حجیت خبر ثقه در موضوعات را احراز بنای عقلا می‌داند.

Analysis Of The Reliable Authority In Subjects With Emphasis On Seyyed Ahmad Khuansari's View

One of the most important sources of Imamiyyah jurisprudence is the tradition in the form of reliable report. And A significant part of it, refers to external threads, but the renowned Osuli's jurisprudents take the view that the scope of the reliable authority credit, Is limited to injunctions and argue that account is a subject concerning with evidence chapter in which justice and witnesse's multiplicity, is an accounting from sense and valid observation.On the other hand, appearance of judicial decrees of jurisprudents, or not, their explicit derees, is that the validity of the reliable authority  is in subjects. This article wants to probe judicial decrees and arguments of opponents and proponents aboute the reliable authority in juridical subjects with a focus on Sayyed Ahmad Khuansari's view by analytical descriptive method, and Through which Specify its scope. The findings indicate that, from the proponents' view, evidence validity, legislated In order to prove these issues belong to the legal and financial claims, and The reliable authority in  other subjects wouldn’t have any problem. as well as Jamiaalmadariks author, criticizing the famous view, considers the reliable authoritie's condition, wise foundation's authentication.
