نقد و بررسی ادلۀ مشروعیت «وقف حقوق معنوی»

از شرایط صحت وقف، مالیت شرعی داشتن، عین بودن، قابلیت قبض و اقباض و ابدی بودن شیء موقوفه است؛ بر این اساس، مخالفان صحت وقف حقوق معنوی، در امکان وقف حقوق معنوی (که حسب کارکردهایش، از موضوعات مهم و مبتلی‌به در حوزۀ مسائل اجتماعی و اقتصادی به‌شمار می‌رود) تردید کرده‌اند. البته موافقانی نیز برای وقف حقوق معنوی وجود دارند که دلایل آنها، اغلب عام، فراگیر و فراوقفی است و با تکیه بر قواعد و اصولی که به باب وقف اختصاص ندارد، وارد نبودن تمام شروط مورد مناقشه را به‌صورت یکجا، به قضاوت نشسته‌اند. این ادله از اصل، الزامی بودن شروط مورد مناقشه را با تردید مواجه می‌کنند. در این تحقیق تحلیلی توصیفی، با نقد و بررسی ادلۀ هر دوی موافقان و مخالفان، این نتیجه حاصل شده است که ادلۀ عام موافقان، صلاحیت بی‌اثر کردن شروط مورد مناقشه را ندارند و به بیان دیگر، از این طریق امکان اثبات مشروعیت وقف حقوق معنوی وجود نخواهد داشت؛ اما از آنجا که اشکال‌های مخالفان با مد نظر قرار دادن: الف) فلسفۀ جعل شروط مورد مناقشه در وقف و ب) بازنگری در مفهوم آنها، وارد شناخته نشده‌اند، صحت و مشروعیت وقف حقوق معنوی اثبات می‌شود.

Criticism and Study of the Legitimacy Evidences of Moral Rights Endowment

One of the conditions for the correctness of endowment is to have a legitimate ownership, objectiveness, ability to possess and eternality of the object of endowment. On this basis, the correctness, the opponents of the correctness of moral rights endowment have cast doubts over the possibility of endowment of moral rights – which according to its functions is one of the important issues in the area of social and economic issues. Of course there are also advocates for the endowment of moral rights whose reasons are mainly general, pervasive and beyond endowment and have judged the conditions under dispute as unacceptable fully  based on rules and principles which are not aimed at endowment. These evidences basically cast doubt over the obligations of conditions under dispute. In this analyticaldescriptive research, through criticism and review of the evidences of both pros and cons, this result has been obtained that the general evidences of the pros are unable to neutral the conditions under dispute and in other words, through this way, it is not possible to prove the legitimacy of the endowment of moral rights, but due to the fact that faults made by  opponents are not acceptable considering A)the philosophy of forging the disputable conditions in endowment and B) revision in their concepts, so the correctness and legitimacy of the endowment of moral rights are proved.
