legal analysis of the right of zakat beneficiaries

Authors nematollahi esmail
Abstract    the relationship between rights and property has long been a subject of focus among islamic jurists. from the perspective of islamic jurisprudence, the manner in which a right is attached to another person’s property is not uniform and takes on various forms. each form carries distinct legal and jurisprudential implications, which are addressed in numerous religious and legal contexts, including khums, zakat, nazr, mortgage, inheritance, and diyah. one particularly significant area of inquiry within this broader discussion is the issue of zakat, specifically the question of how the rights of zakat beneficiaries relate to the zakatable wealth (niṣāb). what distinguishes this area of study is the wide range of rights it encompasses. these include both conventional legal categories - such as personal rights and real rights (primary and secondary) - as well as rights not typically recognized in standard legal classifications. this research aims to analyze the various forms of financial rights from the standpoint of islamic jurisprudence, particularly in relation to their attachment to another individual’s property. the study also reviews the views of contemporary islamic jurists on the nature of the zakat right and seeks to support the argument that the entitlement of zakat beneficiaries pertains to the value of the property, rather than to its substance.
