جستاری در مبانی فقهی «ضرر معنوی» با رویکردی به ضرر معنوی در سوانح هوایی

در نظام حقوقی اسلام با استناد به ادله‌ای مانند آیات، روایات و قواعد فقهی متعدد، حکم به جبران خسارات معنوی داده شده است. در حقوق ایران نیز همگام با پیشرفت جامعه و ظهور افکار نو، قانونگذار زمینه را برای پذیرش زیان‌های معنوی فراهم آورده است. این در حالی است که در موضوع سوانح هوایی و ضررهای ناشی از آن، با استناد به کنوانسیون ورشو و رویه‌های عملی در رسیدگی به این نوع پرونده‌ها، با نوعی تفکیک روبه‌رو می‌شویم. در این تحقیق، ضمن تبیین مبانی فقهی مشروعیت جبران ضرر معنوی به این نتیجه می‌رسیم که تمایز میان زیان‌های معنوی که ریشه در آسیب‌های بدنی دارند و آسیب‌های معنوی صِرف، در کنار زیان‌های مادی، مشکلاتی در رسیدگی به پرونده‌های سوانح هوایی ایجاد کرده است که به بررسی آنها می‌پردازیم.

investigation into the legal principles of spiritual loss with an approach to spiritual loss in air crashes

the legal system of islam, relying on evidence such as verses of the holy quran, narrations and numerous legal rules, issues a verdict to compensate for spiritual damage. in the iranian law too, along with the advancement of society and the emergence of new ideas, the legislator has provided the grounds for accepting spiritual losses. however, considering air crashes and their losses, we face a distinction based on the warsaw convention and practical procedures for dealing with these types of cases. this research explains the legal principles of the legitimacy of the compensation for the spiritual loss. it is concluded that the distinction between the moral losses rooted in physical damage and the mere spiritual damage, along with material losses, has created problems in dealing with cases of air crashes. this study will review these problems.
