دست‌بوسی از منظر فقه ارتباطات غیرکلامی

یکی از گونه‌های ارتباط غیرکلامی، دست‌بوسی است که در بسیاری از فرهنگ‌های جهان رایج است. این رفتار غیرکلامی در فرهنگ مسلمانان نسبت به اعضای بزرگ‌تر خانواده به‌خصوص والدین و نیز نسبت به حاکمان و مهتران اجتماعی و نیز عالمان دینی انجام می‌گیرد. در این زمینه پیام‌هایی چون قدردانی، ابراز محبت و تعظیم منتقل می‌شود. پرسش پژوهه فرارو این است که با توجه به پیام مندرج در این گونه ارتباطی، حکم فقهی آن چیست؟ حاصل تحلیل فقهی ادله در این مسئله نشان داده است بوسیدن دست مشتمل بر هر کدام از سه پیام یادشده اگر با رعایت سه شرط، پرهیز از محرمات مسلم در ارتباطات جنسیتی، پرهیز از تحقیر خود یا تعظیم نادرست دست‌بوسی‌شونده (بیانگر اطاعت محض و سرسپردگی به افرادی که اطاعت آنان اطاعت خدا نیست) انجام گیرد، حرام نیست و اگر در عناوینی چون اکرام مومن و ابراز مودت قرار گیرد، می‌تواند مستحب باشد و اگر ترک آن موجب بی‌حرمتی و اهانت یا اذیت و دل‌شکستگی مومنی که دست‌بوسی او متعارف است (مانند والدین) باشد، حرام است.

Hand Kissing from the Perspective of NonVerbal Communication Jurisprudence

Hand kissing is one of nonverbal communications being common in most of cultures throughout the world. This nonverbal communication is performed in Muslim societies for older family members especially parents, rulers, social dignitaries, and religious scholars. The messages conveyed in this type of communication include the expression of gratitude, love, and obeisance. Considering the messages hidden in this kind of communication, a question raised in this paper as to what is the jurisprudential ruling of this behavior. In this case, jurisprudential analysis comes to this conclusion that hand kissing, carrying each of three above–mentioned messages, is not religiously illegal, if three following conditions are fulfilled: (a) it does not include certain Muslim prohibitions related to forbidden sexual desires, (b) it does not lead to people’s humiliation, and (c) it does not show pure obedience which God, prophets, and infallible ones deserve. If hand kissing is practiced for expression of cordiality and esteem of the believers, it can be recommended. Furthermore, it can be religiously unlawful if its omission leads to harassment, humiliation, or braking the heart of the believers that kissing their hands is conventional.
