ماهیت توریه و بازخوانی نقش آن در جواز و عدم جواز

دروغ یکی ازآسیب‌های جدی در جامعه است و در متون دینی و اخلاقی، پرهیز از آن به انحای مختلف هماره توصیه شده است. توریه عنوان یک راهکار، به‌منظور عدم استفاده از دروغ در کتاب‌های گوناگون فقهی و اخلاقی مورد بحث قرار گرفته است. این پژوهش سعی دارد گسترۀ استفاده از توریه را با توجه به رعایت اصول فقهی و اخلاقی مشخص سازد. به این منظور ابتدا ملاک صدق و کذب خبربررسی و سپس نسبت دروغ و توریهتبیین شده است تا علت جواز و عدم جواز حکم فقهادر استفاده از توریه و حدود آن مشخص شود. داده‌ها در این پژوهش از کتاب‌های معتبر فقهی، منطقی و اخلاقی اخذ شده است و نتایج نشان می‌دهد که گسترۀ استفاده از توریه بسیار بیشتر از ضرورت در دروغگویی است و می‌تواند راهکاری مناسب برای دروغ نگفتن باشد.

The Nature of Dissimulation (Turia) and Reviewing Its Role in Permissibility or NonPermissibility

Lying is one of the most serious harms in society and it is always recommended in religious and ethical texts to avoid it in various ways. Dissimulation as a way of avoiding lying has been discussed in various jurisprudential and ethical books. This research tries to determine the scope of using dissimulation according to the observance of jurisprudential and moral principles. For this reason, first, the criterion of truth and falsity of the news has been examined. Next, the ratio of lying to dissimulation is explained in order to determine the reason for the permission and nonpermission of the rulings of the jurists in using dissimulation and its limits. The data in this study has been taken from authoritative jurisprudential, logical and ethical books. The results show that the scope of using dissimulation is much greater than the need for lying and it can be an appropriate way to avoid lying.
