بررسی و بازنگری ادلۀ لبی حجیت قول صحابه

در کتب اصولی فریقین در باب ادلۀ احکام، دو منبع کتاب و سنت و بعد از آن، اجماع و عقل به‌عنوان منابع مشترک (با اختلاف تفسیر در دو مورد اخیر) به‌چشم می‌خورد. اما در کتب اصولی عامه علاوه بر منابع اربعۀ مذکور، منابع اختصاصی دیگری نیز وجود دارد که دلیلیت آنها در میان اصولیون عامه مورد اختلاف بوده و از جملۀ این منابع، قول صحابی است. برخی از اصولیون عامه قائل به حجیت این اقوال و برخی قائل به عدم حجیت آنها هستند و هردو گروه برای مدعای خود به ادله‌ای استناد کرده‌اند. که این ادله یا لفظی است یا لبی. آن دسته از اصولیون عامه که قائل به حجیت قول صحابه هستند، ادلۀ لبی را به دو صورت اجماع و عقل تقسیم و دلیل اجماع را در دو قالب و دلیل عقلی را در سه قالب طرح کرده‌اند. مسئلۀ مورد بحث این است که آیا این ادله برای اثبات حجیت اقوال صحابه صحیح و کافی هستند؟ در پژوهش حاضر با روش تحلیلی و توصیفی و با هدف دستیابی به ادلۀ واقعی احکام پس از استقرای کتب اصولی عامه و بررسی کلمات اصولیین آنها، به این نتیجه می‌رسیم که ادلۀ این گروه برای اثبات چنین اصلی کافی نیست و در مقابل آنها، نقدهای جدی و پاسخ‌های مستدلی وجود دارد.

Analyzing the NonVerbal Evidences of the Validity of the Word of Companions of the Holy Prophet (PBUH)

It can be seen two sources in the principled (Osuli) books of the Two Islamic Sects on evidences of ruling: the holy Quran and Sunnah, and subsequently, consensus and reason as common sources – with a difference of interpretation in the two later sources. However, the Sunni principled (Osuli) books contain other exclusive resources in addition to Four Main Islamic resources, that their evidentiary is controversial among the Sunni scholars of the principles of jurisprudence including the word of Companions. Some of the Sunni scholars of the principles of jurisprudence believe in the validity of these words and some other believe in their nonvalidity and to prove their arguments both groups have relied upon an evidence either verbally or nonverbally. Those Sunni scholars of the principles of jurisprudence who believe in the validity of the words of Companions have divided nonverbal evidences into two forms of consensus and reason stating the validity of consensus in two forms and rational reason in three forms. It is controversial that whether these evidences are correct and efficient to prove the validity of the words of Companions. Following the induction of the Sunni principled (Osuli) books and reviewing the words of their scholars of the principles of jurisprudence, the research concludes that the group’s arguments are not sufficient to substantiate such a principle and there are serious critique and reasonable answers against them.
