بررسی مشروعیت روش درمانی انتقال میتوکندری

روش انتقال میتوکندری، پدیده‌ای بوده که در سالیان اخیر در پرتو پیشرفت علم پزشکی در حوزۀ تلقیح مصنوعی شکل گرفته است. این روش برای جلوگیری از بیماری‌های میتوکندریایی کاربرد دارد. از آنجا که منشا بروز این بیماری در فرزندان، عملکرد ناصحیح میتوکندری گامت مادر است، دانشمندان هستۀ گامت مادر را به تخمک بدون هستۀ زن دیگری انتقال می‌دهند. به دلیل نوین بودن این نوع باروری، هنوز پژوهشی پیرامون حکم فقهی آن صورت نگرفته است، پس در مقالۀ حاضر سعی می‌شود که با اثبات مشروعیت این نوع روش درمانی در باروری، به این سوال پاسخ دهیم که دلایل مشروعیت روش مذکور بر چه ادله‌ای استوار است. براین اساس با روش توصیفی تحلیلی، ابتدا با در نظر گرفتن نظریۀ مخالف با استناد به آیات و روایات، به نقد و بررسی پرداخته و سپس با استناد به شواهد قرآنی و روایی و قواعد فقهی نفی عسر و حرج، لاضرر، دفع ضرر محتمل و نیز اصاله الاباحه و اصاله البرائه، روش درمانی انتقال میتوکندری با هدف باروری ایمن و تولد کودکان سالم، مشروع شناخته می‌شود.

the mitochondrial transfer method is a phenomenon that has been formed in recent years in the light of the progress of medical science in the field of artificial insemination. this method is used to prevent the mitochondrial diseases. since the origin of the disease in children is the malfunction of the mitochondria of the mother’s gamete, scientists transfer the mother’s gamete nucleus to the nucleus–free egg of another female. due to the modernity of this type of fertility, no research has been conducted on its jurisprudential rules yet. therefore, this article attempts to prove the legitimacy of this type of fertility treatment in order to answer the question as to what the reasons for the legitimacy of this method are. accordingly, this research, using a descriptiveanalytical method, first criticizes the matter considering the opposing theory with reference to the verses and traditions. next, based on the quranic and narrative evidences, as well as the jurisprudential rules of nohardship, nodistress and constriction, nodamage, repulsing possible damage, and also the authenticity of porn and authenticity of righteousness, the mitochondrial transfer method is considered legitimate with the aim of safe fertility and the birth of healthy children.
