هماهنگی حمل بر تقیه با مرجحات اخبار علاجیه در رویّۀ شیخ الطائفه

یکی از عناصری که در بحث تعارض، فتاوای فقهای متاخر از آن متاثر بوده، حمل روایات بر تقیه است. این شیوه را به کرّات می‌توان در آثار شیخ طوسی مشاهده کرد. به‌کارگیری این طریق، هنگام علاج اخبار متعارض، از خصوصیات بارز وی محسوب شده که در دوران ماقبل ایشان، بی‌سابقه بوده است و دو کتاب «تهذیب الاحکام» و «الاستبصار فیما اختلف من الاخبار» نمونه‌های معینی بر این ادعا هستند. پژوهش پیش‌رو با واکاوی عملکرد شیخ طوسی در حمل روایات بر تقیه، با محوریت قرار دادن ترتیب مرجحات مذکور در مقبولۀ عمربن حنظله که با تقدم اعدلیت راوی، شهرت روایت، موافقت با کتاب و مخالفت با عامه مطرح است و همچنین مداقه در سه مورد از نظریات وی به‌عنوان ذکر نمونه، صحت استدلال ایشان در حمل روایات بر تقیه را دچار خدشه می‌کند و وجهی بر آنها ملاحظه نمی‌کند.

Coordination between the Assumptions Based on Dissimulation and the Preferred Remedial Narrations in the Approach of Sheikh AlTā̕ifah

One of the factors influencing the decrees of the contemporary jurists is to convey the narrations based on dissimulation (taqiyyah). This method can often be seen in the works of Sheikh Tousi. Using this method to remove the contradictory narrations was among his significant characteristics which did not have any precedence before his time and the two books namely AlTahdhīb and AlIstibṣār fīmā ikhtalafa minalakhbār are the certain examples of this claim. The present study, analyzing the method of Sheikh i.e. to convey the narrations based on dissimulation and focusing on the sequence of the mentioned preferences in the Maqbūlah of Umar Ibn Hanzalah based on the priority of the  justice of narrator, the popularity of narration, its agreement with the Book, and disagreement with the Sunnis (’Ammah) and scrutinizing three cases of his viewpoints as examples invalidates the Sheikh’s reasoning for conveying the narrations based on dissimulation and does not see any excuse for that.
