بررسی فقهی مسئولیت هزینه‌های زندانی

زندان و زندانی به‌ترتیب از نهادها و عناصر مهم و جدایی‌ناپذیر نظام‌های جزایی مکاتب و کشورهاست. تکالیفی که از سوی آحاد جامعه و به‌ویژه حکومت در قبال زندانی و هزینه‌های جاری وی امکان طرح دارد، از مسائل مهم و مورد ابتلای حکومت‌هاست. اینکه زندانی را سربار جامعه بپنداریم و هزینه‌های جاری او را به خود وی بسپاریم یا وی را یک بیمار اجتماعی تلقی کنیم و انفاق زندانی را به‌تبع وظیفۀ اصلاحش، بر عهدۀ نهاد حاکمیت بپنداریم یا حالت‌های مختلف دیگر که تصور‌شدنی است، مورد اختلاف اندیشمندان در حوزۀ سیاستگذاری بوده و هست. پرداختن به این موضوع از منظر فقهی به دو روش فقه حکم‌محور و فقه نظریه‌محور و همچنین فقه موضوعات و فقه نظامات، شاید ابعاد این مسئله را در مراجعات شرعیه روشن‌تر کند. رجوع به منابع متعدد کتابخانه‌ای فقهی و توصیف و تحلیل متون به روش اجتهادی، روش تحقیق این نوشتار است.

Jurisprudential Review of liability of Prisoner’s Expenses

Prisons and prisoners are essential institutions and elements of the criminal systems of thoughts and the countries. The responsibilities of the community and especially the government to the prisoner and his current expenses is one of the most important issues and concerns that are raised and suffered by the governments. Regarding the prisoner as  an overhead of the society and assigning the payment of his current expenses to him or considering him as a social patient and assigning his expenses as a function of his correctional duty to the government, or other conceivable alternatives have been controversial among scholars in the field of policymaking. Dealing with this issue from jurisprudential point of view through two rulebased or theorybased jurisprudential methods as well as the subjectoriented or systemoriented jurisprudence can clarify the dimensions of this issue by religious references. The present research uses a library method by referring to various jurisprudential sources and describing and analyzing the texts through independent reasoning (Ijtihad).
