چکیده
|
«مروت» به معنای انسانیت و جوانمردی است و در اصطلاح یعنی نزاهت و دور نگهداشتن خود از گفتارهای پست و کارهای فرومایه‌ای که در شان و شایستۀ امثال یک فرد مومن نیست. مروت، شرط یک زندگی متعالی و اخلاقی محسوب می‌شود که قلمرو آن تمام شئون زندگی است و مراتب متفاوتی دارد که بر حسب احوال، اشخاص، شرایط، زمان‌ها و مکان‌ها تغییرپذیر است. اصحاب بامروت، دارای نشانه‌ها و نمادهایی هستند که ثمراتی را در زیست مومنانه و جوانمردانه به‌دنبال دارد. در این پژوهش پس از بررسی ادلۀ موافقان شرطیت مروت در عدالت فقهی و پاسخ به این ادله و بیان ادلۀ مخالفان، به این نتیجه دست یافتیم که با توجه به اینکه ادلۀ موافقان شرطیت مروت، پس از بررسی، نقد شد و از سوی دیگر، مروت و همین‌طور اعمال منافی مروت از مفاهیم لغزنده و سیال بوده و در عرف یا عرف‌های مختلف، تحلیل‌پذیرند، بنابراین «مروت» نمی‌تواند در عدالت فقهی، اعتبار، شرطیت یا جزییت داشته باشد.

Abstract
|
"Compassion" means manliness and chivalry. In academic terms, it means to avoid uttering cheap remarks and doing vile acts which are not meritorious and praiseworthy for the dignity of a faithful individual. Compassion is a necessary condition for a sublime and ethical life whose domain is the whole aspects of the life. It has different stages, varying according to situations, people, conditions, times and locations. Compassionate people have signs and symbols which entail some benefits in a pious life. Upon the verification of the reasons presented by supporters of the conditionality of compassion in jurisprudential justice, answering these reasons and expressing the reasons presented by opponents, the present research has come to the conclusion that owing to the fact that the reasons presented by the supporters were criticized and due to the fact that "compassion" and "countercompassionate actions" are flexible and freeflowing terms, and are analyzable differently in different practices and traditions, the concept cannot be of validity, conditionality, and or particularity in the jurisprudential justice.
