تاملی بر سابقه و حجیت اجماع از دیدگاه اهل سنت

اجماع که یکی از منابع مهم فقهی اهل سنت است و به‌وسیلۀ آنان ابداع و به منابع فقهی مذاهب اهل سنت اضافه شده است، با تعریفی که علمای سنی‌مذهب از آن ارائه داده‌اند، مورد پذیرش فقهای شیعه واقع نشده است. علمای اهل سنت بسیار تلاش کرده‌اند که سابقۀ اجماع را به زمان صحابه ببرند و علاوه بر دلایلی که در راستای حجیت اجماع ارائه کرده‌اند، بر اعتبار آن بیفزایند. این پژوهش که به روش توصیفی تحلیلی انجام‌ گرفته، با هدف بررسی سابقه و حجیت اجماع از نظر علمای اهل سنت صورت گرفته و این دو ادعا را به نقد کشیده و رد کرده است.

Pondering upon the Background and Legitimacy of Consensus in the Sunni Point of View

Consensus is one of the important jurisprudence resources of the Sunni which is invented by them and added to other jurisprudential resources of Sunni denominations; however, the definition presented by Sunni scholars is not accepted by Shi’ite jurisprudents. Sunni scholars have tried their best to bring the precedence of consensus to the time of Companions and hereby to raise its validation in addition to presenting reasoning to legitimate consensus. This research uses a descriptiveanalytical method and aims at reviewing the background and legitimacy of the consensus in Sunni scholars’ point of view. It has criticized both claims and finally refused them.
