تجدید بنای پایه‌های نظری فقه اباضیه در دورۀ معاصر

یکی از اصولی که تمام مذاهب برای ادامۀ حیات خود به آن نیاز دارند، بازسازی و تجدید بناست. اباضیه هم برای بازسازی مذهب خود به سراغ بازسازی و تجدید بنای پایه‌های نظری فقه خود رفته تا از این راه، موجودیت خود را در میان مذاهب اسلامی حفظ و هر روز به رشد و تعالی بیشتری دست پیدا کند. این رویکرد از سوی اباضیه معاصر در ضمن نه محور تعقیب می‌شود که مهم‌ترین آنها عبارتند از تجدید بنا در ماده و مصادر و منابع فقه، اهتمام به مطالعات تطبیقی و مقارن، پویاسازی فقه مقاصدی، شکلدهی به پژوهش‌های نوین فقهی و بازسازی شاکلۀ فقه. فقه اباضیه شش دوره را پشت سر گذاشته که دورۀ معاصر دارای اهمیت بسزایی است. به لحاظ آنکه توجه خاص به تجدید و تیسیر فقه شده است، این مقاله با رویکرد توصیفی تحلیلی و با روش کتابخانه‌ای به تجدید بنای پایه‌های نظری فقه اباضیه می‌پردازد.

Reconstruction of the Theoretical Foundations of Abaziyah Jurisprudence in the Contemporary Period

All religious denominations need to be reconstructed and renewed in order to survive. In order to reconstruct their denomination, Abaziyah embarked upon a reconstruction and reestablishment of the theoretical foundations of their jurisprudence (fiqh) so as to survive as an Islamic denomination and increasingly develop and grow. Such an approach is followed by contemporary Abaziyah within nine pivots, the most important of which include: reconstruction of materials and sources of jurisprudence, engagement in comparative studies, dynamicization of purposebased jurisprudence (alfiqh almaqasidiyyah), formation of new jurisprudential research, and reconstruction of the schema of jurisprudence. Abaziyah jurisprudence has undergone six stages, the contemporary period being of particular importance. Since the reconstruction and facilitation of jurisprudence has been particularly taken into account, this paper tackles the reconstruction of the theoretical foundations of Abaziyah jurisprudence with a descriptiveanalytic approach and the library research method.
