تبیین مصلحت به‌مثابۀ سنجه و شاخصِ ولایت قهری

شاخص مصلحت در سراسر احکام مربوط و مرتبط با ولایت قهری خود را نشان می‌دهد.تشریع ولایت قهری به قصد تامین مصالح مولی‌علیه است. یعنی این نهاد در اصل وضع، مبتنی بر مصلحت خواهد بود. البته مصلحت مندرج در ولایت قهری، همانند عبادات نیست که صرفاً تعبدی و خارج از فهم باشد. در تحقق، ضوابط و نیز ویژگی‌های «ولی» و همچنین در صحت و نفوذ تصرفات، مصلحت به‌مثابۀ شاخص و سنجه‌ای قوی،این مسیر (راه) و مصیر (نتیجه) را کنترل، هدایت و پایش می‌کند. درستی پیمودن فرآیند ولایت از آغاز تا پایان و نیز صحه‌گذاشتن بر نوع نتیجۀ به‌دست‌آمده، روایی و نفوذ تصرفات، مرهون اِعمال و عمل به این معیار است. واگذاری این جایگاه به پدر و جد پدری، بازگشت ولایت، با در نظر گرفتن بایستگیِ تحقق خواستۀ شارع در دستیابی به مصالح طفل و در واقع، به پشتوانۀ اصل مصلحت است که کاملاً موجه و مدلل به‌نظر می‌رسد. انگارۀ تسهیم/ تفویض مادر در ولایت، دلایل قوی و قویم ندارد و این یعنی از شاخص مصلحت، بی‌بهره است. مصالح چندگانۀ جامعه، فرزند، مادر، خانوادۀ جدید، مانع از این تسهیم/ تفویض است.در مقام اجرا، التزام به اصل مصلحت (نه عدم مفسده) البته به‌گونه‌ای متعارَف (و نه نفس‌الامری) خود واجد مصلحت است. تبیین و گزارشی تبیینی از چگونگی نُمود و ظهور اصل مصلحت در ولایت قهری و گزاره‌های مترتب و مربوط، بایسته‌ای است که این جُستار برای خود ترسیم کرده است.

Defining Expediency as a Scale of Forcible Guardianship

Scale The Expediency can be clearly observed in all the Islamic commandments related to natural guardianship. The divine law regarding natural guardianship is intended to guarantee the best interests of the ward. Of course,the term best interest is different from that in prayers,which is beyond human understanding.Guardianship as well as the regulations and characteristics set forth for the guardian , and in the context of the veracity and ratification of the relevant possessions, the Expediency is used as a scale to control, guide, and monitor both in process and the results.Transferring a child’s guardianship to the father (or to the grandfather) shall be enforced with due consideration of the necessity of realizing the legislator’s demand in achieving the infant’s Expediency;and such transfer is, in fact, supported by the Principle of Expediency which seems perfectly reasonable and justifiable.The assumption of mother’s sole/shared custody lacks sufficient upright reasoning . Transferring guardianship to the mother or giving the mother shared custody of the child would be against the multiple interests of the society, the child, the mother, and the newly founded family.This study reviews the emergence and adoption of the Principle of Expediency in natural guardianship and the statements related thereto in Islam.
