تحلیل تحولات کیفر حبس از زاویۀ جامعه‌شناسی فرهنگ در ایران پساانقلاب

فراگیر شدن مجازات‌های بدنی در دهۀ اول انقلاب اسلامی و به حاشیه رفتن زندان‌ها معلول حاکمیت گفتمان سنت‌گرای مذهبی بود. در این دوران، مجازات زندان که پیش از انقلاب مجازات اصلی اغلب جرائم بود، کنار‌گذاشته شد. این در حالی است که پس از مدتی، کیفر حبس مجدداً احیا شد. پرسش این است که چرا در دوره‌ای از تاریخ، زندان در حاشیه ‌قرار می‌گیرد، اما در برهه‌ای دیگر، تبدیل به مجازات اصلی جرائم می‌شود؟ این مقاله بنا دارد از حوزۀ جامعه‌شناسی فرهنگ برای تحلیل علّی این وقایع استفاده کند. در این پژوهش، از میان رویکردهای مختلف جامعه‌شناسی فرهنگ، دو رویکرد کلاسیک که دیدگاهی ذهنی به فرهنگ دارد، و رویکرد پساساختارگرا که دارای رویکرد عینی به فرهنگ است، مورد استفاده قرار گرفته‌اند. در نهایت، می‌توان نتیجه‌گرفت که مجازات‌ها به‌طور عام و زندان به‌طور خاص، پدیداری اجتماعی است که از سایر پدیده‌های اجتماعی همچون فرهنگ تاثیر می‌پذیرد. بنابراین می‌توان زندان را انعکاس‌بخش عناصر فرهنگی نظام اجتماعی دانست.

analysis of the evolution in imprisonment from the perspective of the sociology of culture in post-revolution iran

the prevalence of corporal punishments in the first decade of the islamic revolution and the marginalization of prisons were the result of the dominance of the religious traditionalist discourse. during this period, imprisonment, which had been the primary punishment for most crimes before the revolution, was set aside. while, after some time, the punishment of imprisonment was revived. the question is why imprisonment became marginalized in one period of history, but in another period, it turns to the primary penalty. this paper intends to utilize the field of sociology of culture for a causal analysis of these events. in this paper, among the various approaches relating to the sociology of culture, two approaches have been observed: the classical, which adopts a subjective perspective on culture, and the post-structuralist, which offers an objective perspective on culture. ultimately, it can be achieved that punishments in general, and imprisonment in particular, are social phenomena influenced by other social phenomena, such as culture. therefore, prison can be considered as a reflection of the cultural elements of the social system
