مطالعۀ تطبیقی تحولات مسئولیت کیفری در حقوق کیفری ایران و افغانستان (با تاکید بر قبض و بسط‌های سن مسئولیت کیفری)

قواعد حاکم بر مسئولیت کیفری در نظام‌های حقوقی ایران و افغانستان فراز و نشیب‌های متعددی داشته است. هدف پژوهش حاضر تبیین مراحل تحول مسئولیت کیفری در حقوق کیفری ایران و افغانستان و ارائۀ پاسخ به این مسئله است که مسئولیت کیفری، به‌ویژه سن مسئولیت کیفری کودکان، چه مراحلی را در حقوق کیفری ایران و افغانستان طی نموده و نقاط افتراق و اشتراک آن‌ها کدام‌اند. یافته‌های پژوهش بیانگر آن است که مهم‌ترین مولفه‌ها و مصادیق تحولات مسئولیت کیفری در حقوق کیفری دو کشور، گذار به سن مسئولیت کیفری تدریجی، تساوی سن مسئولیت کیفری دختران و پسران 9 تا 15 سال و پذیرش مسئولیت کیفری نقصان‌یافته در جرائم حدی و تعزیری است. داده‌های پژوهش از طریق مطالعات کتابخانه‌ای، جمع‌آوری شده و بر اساس روش تحلیلی – توصیفی، بررسی گردیده است.

comparative study of the evolution of criminal liability in the penal code of iran and afghanistan (with emphasis the expansion and restrictions of the age of criminal liability)

the rules governing criminal liability in the legal systems of iran and afghanistan have experienced numerous fluctuations and transformations. the purpose of this research is to elucidate the stages of the evolution of criminal liability in the penal code of iran and afghanistan and to provide an answer to the question what stages criminal responsibility, particularly the age of criminal liability for children, has undergone in the criminal law of iran and afghanistan and what the points of  divergence and convergence between them are. the findings show that the most important components and instances of the evolution of criminal liability  in the penal code of both countries are the transition to a gradual age of criminal liability, the equalization of the age of criminal liability for both girls and boys between 9 and 15 years, and the acceptance of diminished criminal responsibility in hudud  (fixed sharia punishments)and ta’zir  (discretionary punishments) crimes. the research data has been collected through library studies and analyzed  applying the analytical-descriptive method.
