مخاطرات خشونت خانگی علیه زنان و راهکارهای پیشگیری از آن

خشونت خانگی یا سوءرفتار نسبت به زنان، به‌عنوان یک پدیده فراگیر در سراسر جهان، قربانیان را در معرض مخاطرات جدی قرار داده است. در مواجهه با خشونت خانگی، به‌دلیل عدم جرم‌انگاری گونه‌های مختلف این خشونت و یا عدم گزارش آن به‌دلیل وجود رابطه خانوادگی میان آزارگر و قربانی، راهکارهای قضایی پسینی، کارآمدی لازم را ندارند و بزه‌دیدگی ثانویۀ قربانیان را نیز رقم می‌زنند. از این رو، راهکارهای پیشینی حمایتی و پیشگیرانه موضوعیت می‌یابند. قربانیان بر اثر شکل‌های شدید خشونت خانگی دچار جراحات جسمی شده و در مواردی حیات خود را از دست می‌دهند. همچنین گاهی به‌دلیل فشارهای روانی ناشی از سوءرفتار، دست به واکنش‌های انفعالی مثل خودکشی یا شبه خودکشی می‌زنند. خشونت یا سوءرفتار جنسی در شکل‌های متنوع خود نیز مخاطراتی برای زنان در پی دارد. در لایحه جدیدِ در حال بررسی در قوه مقننه ایران، با تقدم اقدامات حمایتی و پیشگیرانه بر اقدامات کیفری، تلاش‌هایی برای انسجام‌بخشی و ایجاد پنجرۀ واحدِ خدمات حمایتی برای زنان در دستور کار قرار گرفته که در این مقاله با عنوان حمایت اضطراری، حمایت مشارکتی و ترمیمی و حمایت اقتصادی و فرهنگی مورد بررسی قرار گرفته‌اند. استفاده از تجربه‌های بین‌المللی و رفع چالش‌ها در تصویب این لایحه و اجرای سازوکارهای حمایتی و پیشگیرانۀ آن می‌تواند به کارآمدی سیاست جنایی در این زمینه و کاهش آسیب‌ها کمک کند.

domestic violence or abuse of women has exposed victims to serious risks as a pervasive phenomenon around the world. the latter judicial strategies are not effective in confronting domestic violence due to the lack of criminalization of different types of violence or the lack of reporting it due to the existence of a family relationship between the abuser and the victim, and therefore, secondary victimization of victims is also a result. therefore, previous supportive and preventive solutions are relevant. victims suffer severe forms of domestic violence and sometimes lose their lives. they also sometimes resort to passive interaction such as suicide or pseudo-suicide due to psychological pressure caused by misbehavior. violence or sexual misconduct in its various forms also causes risks for women. efforts to integrate and create a single window of support services for women are on the agenda in the new bill under consideration in the legislature of islamic republic of iran with the priority of protective and preventive measures over criminal measures which are discussed in this article under the title of emergency support, collaborative support and restorative support and economic and cultural support. the use of international experience and the elimination of challenges in the passage of this bill and the application of its protective and preventive mechanisms can help the effectiveness of criminal policy in this regard and reduce damages.
