مساله شناسی فساد اقتصادی از منظر دغدغه های سیاسی-امنیتی

فساد اقتصادی به عنوان مجموعه‌ای از رفتارهای مجرمانه که مرتکبِ آن از جایگاه و موقعیت خود سوءاستفاده می‌کند و از این طریق، امتیاز یا منفعت مالی برای خود یا دیگری به ناحق به دست می‌آورد، با اثرگذاری بر سلامت نظام اقتصادی و اداری، از موضوعات حائز اهمیتی است که به عنوان مسئله‌ای عمومی از سوی سیاست‌گذاران فهم می‌شود. این مسئله به دلیل چندوجهی بودن، عرصه‌ها و حوزه‌های مختلفی را تحت‌الشعاع قرار می‌دهد و دغدغه‌های گوناگونی می‌آفریند که یکی از آن‌ها، دغدغه سیاسی امنیتی است. این پژوهش برای پاسخ به این پرسش که «در فرایند قانون‌گذاری کیفری در حوزه فساد اقتصادی، دغدغه‌های سیاسی امنیتی چگونه در مرحله تعریف مسئله نقش‌آفرینی می‌کنند؟» از روش نظریه‌پردازی داده‌بنیاد بهره برده است. یافته‌ها حاکی از این است که دو مفهوم اصلی تمامیت و مطلوبیت نظام، دغدغه سیاسی را می‌سازند و با ارتباط یافتن با موجودیت و مشروعیت نظام، این مسئله را در ذهن کنشگران برجسته می‌نماید. این دغدغه در توجیه فساد اقتصادی به عنوان مسئله‌ای در خورِ سیاست‌گذاری کیفری و سوق دادن تصمیم‌گیران برای توجه به آن، به عنوان پیشرانی قدرتمند نقش‌آفرینی می‌کند.

The Problem of the Economic Corruption from the View of the Political-Security Concerns

Economic corruption is a collection of criminal behaviors in which its Perpetrator abuses his position and situation and through it has illicitly gained privilege or financial benefit for himself or the other person with influencing the economic and administrative soundness is important. it is understood as a public problem by politicians. This matter for having many aspects affects different fields and areas and creates different concerns that the politicalsecurity is one of these concerns. This paper attempts to answer the question that in the process of criminal lawmaking in the area of economic corruption how the politicalsecurity concerns play role in the stage of the definition of the problem. It has employed the method of the grounded theory. The findings indicate that two basic concepts of the integrity and utility of the system of the government make the political concern and with connection to the existence and legality of the system of the government this problem is highlighted in the thought of the activist. This concern in the justification of the economic corruption as a problem appropriate to be adopted criminal policy and to encourage the decisionmakers to call attention to it plays a role as an influential force.
