مجازات قتل در تکرار جرایم منافی عفت با تاکید بر تکملة المنهاج

مشهور فقهای امامیه با استناد به معتبرۀ ابوبصیر، حکم به قتل مرتکب جرم منافی عفت حدّی در مرتبه چهارم داده‌اند و عده قلیلی نیز با استناد به صحیحه یونس، قائل به قتل مرتکب در مرتبه سوم هستند.نگارنده در این مقاله در پی آن بوده است تا حکم تکرار جرایم منافی عفتِ مستوجب حد را که مجازات آن اعدام مرتکب می‌باشد و همچنین ادله آن را در آراء فقهای امامیه بررسی نماید. از طرفی، به نحو انحصاری به نظر آیةاللّٰه خویی در تکملة المنهاج که قائل به تفکیک رای در بار سوم و چهارم بین مصادیق مختلف این جرایم است، بپردازد و نیز به طور مبسوط، ادله اقوال را نقد کند و در نهایت با لحاظ لزوم تدقیق در احکام شرعی و تاکید بر مخدوش بودن برخی از ادله و ناسازگاری آشکار آن با لزوم رعایت احتیاط در دماء، ماده 136 ق.م.ا. 1392 را مناسب‌تر با احتیاط می‌داند.

The Criminology Approach to Online Threats to Girls

Threats to the girls in the real space (physical space) or cyberspace from the view of the cognitive science (meaning the process of the inner of the mind) which embodies the far more vulnerable indicates the dangerous state of the perpetrator and it needs the appropriate action (dynamic) responses from the government and civil society from one side and the criminal immediate reaction measures from the other side. Criminal intervention related to the threats in the real space (physical space) was viewed the subject of the preventive security measures since 1339 and in 1375 it changed to an independent offense but its prevention aspect was neglected but its online type is paid less attention by the legislature. The present paper with analyticdescriptive method and with studying the decisions of the criminal courts: meanwhile determining the various types of the online treats to the girls in the teaching environments it has examined and mentioned the legal vacuums, the causation and the prevention method of passing from thought to action and at the end based on the criminological studies it has presented the preventive suggestions.
