بایسته‌های ارزیابی اجرای مقررات؛ راهکار ارتقای کیفیت نظام مقررات‌گذاری

عدم اجرای مقررات یا دست کم اجرای ناقص آن‌ها یکی از اصلی‌ترین چالش‌های نظام مقرره‌گذاری کشور محسوب می‌شود. در این زمینه هرچند مقررات‌گذاری شرط لازم عمل به تکالیف قانونی تلقی می‌شود اما شرط کافی نیست و آغاز راه اجرای مفاد قانونی محسوب می‌شود. آنچه این فرآیند را تکمیل می‌کند و موجبات اجرایی شدن مقررات و افزایش کارآمدی نظام مقررات‌گذاری را فراهم می‌آورد، انجام فرآیند «ارزیابی اجرای مقررات» است. در این زمینه سوال اصلی پژوهش حاضر به تعیین بایسته‌های ارزیابی اجرای مقررات و نحوه کاربست آن در مقررات مصوب هیات وزیران اختصاص دارد. یافته‌های این پژوهش با اتخاذ روش توصیفی- تحلیلی و بهره‌گیری از منابع کتابخانه‌ای و مصاحبه‌های نخبگانی بیانگر آن است که در میان مراجع زیرمجموعه قوه مجریه، ضمن آنکه «دفتر هیئت دولت» مناسب‌ترین مرجعی است که به نحو بهینه می‌تواند عهده‌دار این امر گردد و تمامی دستگاه‌ها و وزارتخانه‌های دولت را گرد هم آورده و موضوعات را از جنبه‌های مختلف آن مورد بررسی و ارزیابی قرار دهد، کاربست اجرای این فرآیند مستلزم رعایت مولفه‌ها و بایسته‌هایی چون تعیین دستگاه‌ها مخاطب اجرای مقررات، تبدیل احکام مقررات به شاخصه‌ها و معیارها، تعامل با ذینفعان و مخاطبین اجرای احکام و تکالیف، طراحی چک لیست اختصاصی متناسب با هر مقرره، لزوم ارسال و دریافت گزارش‌ها و مستندات عملکرد، انتشار گزارش‌های ارزیابی اجرای مقررات و در نهایت ارائه راهکارهای اصلاحی مختلف به منظور ارتقاء کیفیت مقررات و در عین حال عینیت‌یافتن آن‌ها در عالم واقع است.

non-implementation of regulations or at least their incomplete implementation is one of the main challenges of the country's regulatory system. in this context, although regulation is considered a necessary condition to comply with legal obligations what completes this process and brings about the enforcement of regulations and increasing the efficiency of the regulatory system is the evaluation of the implementation of regulations process. in this context, the main question of the current research is dedicated to determining the requirements for evaluating the implementation of regulations and how to apply them in the approvals of the council of ministers. the findings of this research by adopting the descriptive-analytical method and using library sources and elite interviews show that among the branches of the executive branch, while the government board office is the most suitable authority that can optimally handle this matter and all the institutions and bring together the government ministries and examine and evaluate the issues from its various aspects, the implementation of this process requires compliance with the components and requirements such as determining the target institutions for the implementation of the regulations, converting the provisions of the regulations into indicators and criteria, interacting with the stakeholders and audiences implementing orders and assignments, receiving performance reports and documentation, publishing evaluation reports on the implementation of regulations, and finally providing various corrective solutions in order to improve the quality of regulations and at the same time find their objectivity in the real world.
