ارتقاء حقوق بشر در پرتو تحول ساختاری حقوق بین‌الملل (مطالعه موردی تحولات کشور لیبی 2011)

این پژوهش باهدف ارتقاء حقوق بشر در پرتو تحول ساختاری حقوق بین‌الملل انجام‌شده است و به‌طور خاص به مطالعه موردی بحران لیبی در سال 2011 پرداخته است و درصدد پاسخگویی به این سوال است که چگونه توسعه و تحول ساختاری حقوق بین‌الملل موجب ارتقاء حقوق بشر، و کاربست آن در لیبی شده است؟ تحولات ساختاری حقوق بین‌الملل نشان دهد که در گذشته و قبل از جنگ جهانی دوم، حاکمیت دولت در ابعاد داخلی و خارجی مبتنی بر دو اصل احترام به حاکمیت و عدم‌مداخله در امور داخلی سایر دولت‌ها بوده، بدین معنا که فعالیت دولت‌ها و اختیارات آن‌ها به حقوق بین‌الملل مقید و وابسته نبوده است. حوادثی مانند جنگ‌های جهانی اول و دوم، زمینه پیدایش تحولات هنجاری و ساختاری حقوق بین‌الملل و توجه به حقوق بشر را فراهم کرد. شواهد نشان می‌دهدکه تحولات ساختاری به‌عنوان مکمل تحولات هنجاری، زمینه اجرایی کردن هنجارهای حقوق بشر را ایجاد نموده است به‌نحوی‌که امروزه سازوکارهای بین‌المللی حقوق بین‌الملل نقض بنیادین حقوق بشر را به‌مثابه نقض صلح وامنیت بین‌المللی تعریف کرده و با ناقضان آن برخورد می‌کند و یا حاکمیت مطلق گذشته دولت‌ها را با دفاع از حقوق بشر به چالش می‌کشد. بحران لیبی در خاورمیانه در سال 2011 از نمونه‌های نادری است که در طول تحولات تاریخی مشمول ورود این سازوکارهای بین‌المللی قرارگرفته است. چراکه سازمان‌های منطقه‌ای و بین‌المللی حامی حقوق بشر با نادیده گرفتن عدم توسل به‌زور درمنشور ملل متحدبه دفاع از مردم لیبی درناآرامی‌های داخلی آن کشور به‌صورت عملیاتی ورود کرده و سرانجام معمر قذافی را از صحنه سیاست لیبی حذف کردند.

the advancement of human rights in light of the structural transformation of international law (a case study of the developments in libya 2011)

this research aims to promote human rights in light of the structural transformation of international law, with a specific focus on the case study of the libyan crisis in 2011. it seeks to answer the question of how the development and structural transformation of international law have contributed to the advancement of human rights and its application in libya. structural changes in international law indicate that, prior to world war ii, state sovereignty in both internal and external dimensions was based on two principles: respect for sovereignty and non-interference in the internal affairs of other states. this meant that the actions and powers of states were not bound by international law. events such as the world wars i and ii created the conditions for normative and structural transformations in international law and the increased focus on human rights. evidence suggests that structural transformations, as a complement to normative changes, have facilitated the enforcement of human rights norms, tothe extent that today, international legal mechanisms treatfundamental human rights violations as breaches ofinternational peace and security, addressing the violators accordingly, and challenging the absolute sovereignty ofstates by advocating for human rights. thelibyan crisis in the middle east in2011is one ofthe rare examplesin historical developments where these international mechanisms were actively engaged. this is because regional and international human rights organizations, by disregardingthe prohibition of the use of force in the united nations charter, intervened operationally todefend the people oflibya during the internal unrest, eventually removing muammar gaddafifrom the political scene of libya
