بررسی نقش سیستم قضایی جمهوری اسلامی ایران در حمایت از محیط زیست شهری

طبق قانون اساسی، حفاظت از محیط زیست به عنوان وظیفه همگانی بر عهده مردم و دولت است. در این خصوص نقش دادستان به عنوان مدعی العموم دارای اهمیت است و مطابق قانون وظایف و اختیاراتی بر عهده وی قرار داده شده است. در این خصوص وی به عنوان حافظ حقوق عامه وظیفه اعلام جرم و تعقیب قانونی تخریب کنندگان محیط زیست را داشته و از جایگاه مدعی العمومی که بر عهده دارد از این حق شهروندان حفاظت می کند و در مواردی که حفاظت از محیط زیست ایجاب کند اقدام به صدور دستورات ویژه مانند تعطیلی کارخانه ها و صنایع آلوده ساز کرده و با مجرمان محیط زیستی برخورد می کند. اضافه بر آن مطابق قانون و با اختیاراتی که دارد بر ضابطان دادگستری نظارت کرده و تعلیمات لازم را در زمینه حفاظت از محیط زیست به آنها می دهد و بالاخص با ضابطان خاص مانند مامورین سازمان حفاظت از محیط زیست، منابع طبیعی و نهادهای غیردولتی در زمینه محیط زیست ارتباط دارد.
