تاثیر ارزش های اجتماعی بر تحوّل مجازات با تاکید بر جغرافیای فرهنگی

بشریّت در طول ادوار مختلف، شاهد تحوّلاتی بوده است؛ تحوّلاتی که با گذر زمان و شکل گیری دولت ها و تحت تاثیر ارزش های اجتماعی، قابلیّت دگرگونی مجازات ها را نیز دارد. ارزش هایی که صرفاً منحصر به فلسفه خاصّی نیست و در تمام جوامع، بدون توجّه به اختلافات جغرافیایی، مقبول طبع بشریّت است. بر این اساس، مسئله مورد بررسی آن است که کدام یک از ارزش های اجتماعی بیشترین میزان تاثیرگذاری بر تحوّل مجازات را با تاکید بر جغرافیای فرهنگی خواهد داشت؟نتایج تحقیق، نشان می دهد که در تمامی جوامع، ارزش های اجتماعی با گفتمان های مختلف وجود دارد امّا در مننطقه جغرافیایی ایران، ارزش های مبتنی بر اخلاق و فرهنگ، به نسبت، توانایی تاثیرگذاری حدّاکثری بر تحوّل مجازات را خواهند داشت. به گونه ای که تصوّر تاثیر فشارهای سیاسی بر تحوّل مجازات، به خصوص در مجازات های سختی چون رجم و شلّاق به حدّاقل رسیده است. بنابراین، امروزه نظام کیفری ایران از رهگذر توسعه آزادی و دموکراسی و به اقتضای مصلحت و با ابتناء بر ارزش های اجتماعی، قابلیّت تعطیلی و یا جایگزینی یکچنین مجازات هایی را یافته است که این امر می تواند به نوعی، مبیّن انسانی تر شدن مجازات ها باشد.

The impact of social and cultural values on the evolution of punishment with the emphasis on cultural geography

Humanity has withnessed changes during different priods, changes that with the passage of time and the formation of governments and under the influence of social values have the ability to change punishments. Values that are acceptable to societies, regardless of geographical differences and are necessary to defend it that depending on the structure of society, the imoact of each of these values will be different. Accordingly, the question under consideration is which of the social values will have the greatest impact on the evolution of punishment with emphasizing on cultural geography. The results of the study indicate that societies, in all societies,there are social values with different discourses, but in the geographical region of Iran, values based on ethics and culture will have the ability to have the maximum impact on the punishment. In such a way that the perception of the impact of political pressures on the evolution of punishment, especially in severe punishments such as stoning and flogging has been minimized. Therefore, today the Iranian criminal policy through the development of freedom and democracy and in accordance with expediency and also based on social values, has found the ability to abolish or replace such punishnents, which can also be a sign of more humane punishmenys.
