نقدی بر رویکرد نظام کیفری ایران درقبال جرایم علیه محیط زیست (جغرافیای انسانی) با نگاهی بر کنوانسیون های بین المللی

حقوق محیط زیست در عصر حاضر بیش از هر زمان دیگر مورد توجه بین المللی قرار گرفته است، در این میان تببین نقش و جایگاه حقوق محیط زیست در نظام کیفری کشورها از اهمیت زیادی برخوردار است چراکه ضمانت اجراهای کیفری مهم ترین پاسخ به جرایم زیست محیطی است. رویکرد نظام کیفری ایران نیز درخصوص جرایم زیست محیطی همواره با چالش های فراوانی مواجه بوده است و در عصر حاضر نیازمند نقد و اصلاح است. آنچه از بررسی قوانین داخلی مشخص است آن است که قانونگذار کشور ما رویه یکسان و منسجمی در قبال جرایم زیست محیطی اتخاذ نکرده است. از طرف دیگر بطور کلی قوانین کیفری ایران در حوزه محیط زیست از رویکردهای جهانی فاصله دارد و توجه به اسناد بین المللی و کنوانسیون ها در تدوین قوانین زیست محیطی از اهمیت فراوانی برخوردار است. لذا علاوه بر ایجاد یک رویکرد منسجم و یکپارچه در قوانین کیفری، توجه به اسناد بین المللی و همگامی با رویکردهای بین المللی نیز باید مورد توجه قانونگذار ایران باشد.

Criticism of the Iranian Penal System’s Approach to Crimes against the Environment (Human Geography) with a Look at International Conventions

Environmental law has now received more international attention than ever before, and it is important to understand the role and status of environmental rights in countries’ criminal systems, as guaranteeing criminal penalties is the most important response to environmental crimes. The Iranian penal system’s approach to environmental crime has always faced many challenges and now requires criticism and reform. What is clear from the review of domestic law is that our country’s legislator has not adopted a uniform and consistent approach to environmental crime. On the other hand, in general, environmental laws in Iran are far from global approaches and attention to international documents and conventions is important in the formulation of environmental laws.
