رویکرد ضد-ژئوپولیتیکی مبتنی بر مولفه های عدالت محور در رویه های قضایی سازمان تجارت جهانی

دوران جدید یعنی دوره ی پس از پایان جنگ سرد تا برهه فعلی را می توان دوره شکوفایی سازمانهای بین المللی در نظام روابط بین الملل دانست. به ویژه در برهه  اخیر که تاسیس و گستره فعالیت ده ها سازمان مختلف بین المللی با شتاب زیادی نسبت به گذشته، صورت گرفته است. این موضوع را می توان معلول تشخیص نیاز مبرم به این نهادهای بین المللی در عرصه روابط بین الملل در کنار دولت ها و همینطور پایان یکجانبه نگری ایالات متحده امریکا در نظام ژئوپولیتیکی جدید دانست.  با وجود تحولات فوق الذکر به علاوه وابستگی بیش از پیش کشورها و مناطق، توسعه روابط بین الملل، سازمان دهی و قاعده مند کردن این روابط چند جانبه را بیش از گذشته ضروری ساخته است. نتیجه این توسعه نقش سازمانهای بین المللی در روابط خارجی کشورها،  تاثیر پذیری خودکار مصوبات و اقدامات سازمانهای بین المللی از اوضاع جدید است. با این توضیحات ، سازمان تجارت جهانی (wto) یکی از سازمانهای بین المللی است که از با توجه به توازن های که می تواند در ساختار نظام جهانی ایجاد کند، دارای اهمیت ویژه ای می باشد. براین اساس  نوشتار حاضر با بررسی  یکی از فرایندهای موثر در ایجاد توازن یعنی فرایندهای قضایی سازمان تجارت جهانی با تاکید بر رویکردهای موجود در قبال کشورهای در حال توسعه  با روش توصیفی و تحلیلی براساس مطالعات اسنادی و کتابخانه ای تهیه و تنظیم شده است. نتایج پژوهش حاضر نشان می دهد که رویه های فعلی  wto به طور کلی و رویه های قضایی این سازمان به طور خاص با دادن امتیازاتی به کشورهای عمدتا در حال توسعه جدای از اینکه به دنبال تعدیل رویه های ژئوپولیتیکی (سابقا غالب) بوده است برای رفع نابرابری ها جهت تامین عدالت اقتصادی در بررسی های قضایی خود ، رویکردهای ضدژئوپولیتیکی شامل رویه های عدالت محور را مد نظر قرار داده است.

Anti-Geopolitics approach based on components of economic justice in WTO jurisprudence
