تزاحم حق بر محیط زیست انسان با حق بر توسعه از منظر شریعت

یکی از معضلات حوزه محیط زیست، تزاحم میان حق بر محیط زیست و حق بر توسعه است. زیرا از سویی توسعه در ابعاد گوناگونش برای زندگی بشر اجتناب‌ناپذیر است و از سوی دیگر، اغلب، توسعه به تخریب محیط زیست می‌انجامد. سازمان ملل برای حل این مشکل در میثاق‌های متعدد بین‌المللی، همانند اعلامیه استکهلم و اعلامیه ریو، «اصل توسعه پایدار» را به‌ عنوان راه‌حل مطرح کرده، که حفظ محیط زیست و تامین نیازهای نسل‌های آینده از محورهای اساسی آن است. در این نوشتار با بررسی آیات، روایات، قواعد فقهی و روش عقلا، ضمن تبیین دیدگاه شریعت درباره جایگاه حق بر محیط زیست و حق بر توسعه، نارسایی‌های «اصل توسعه پایدار» را نشان می‌دهیم و ثابت می‌کنیم که راه‌حل واقعی تزاحم این دو حق، توسعه عدالت‌محور اسلامی است. نهادینه‌سازی قداست محیط زیست، اخلاق محیط زیست، احکام محیط زیست، حقوق محیط زیست اسلامی و نیز عدالت سیستمی و جهان‌شمول، عدالت میان‌نسلی و عدالت درون‌نسلی از محورهای اساسی توسعه عدالت‌محور اسلامی است.

On the Conflict between Human’s Rights of Environment and Development from the Perspective of Divine Law

The conflict between human’s right of environment and his right of development has been amongst intricacies in the field of environment because, on one hand, the development is inevitable for human life and on the other, development almost results in the destruction of the environment. Therefore, to solve this problem, the United Nations has underscored the principle of sustainable development in many international treaties including declarations of Rio and Stockholm in which protecting the environment and securing the needs of the coming generations is axiomatic. Studying Quranic verses, tradition and views of scholars, the current study has explained the view of divine law on this conflict and uncovered the inefficiencies of the principle of sustainable development. It is also suggested that the solution to the conflict resides in the Islamic justicebased development. Institutionalization of the holiness of environment, environmental ethics, environmental religious commandments, Islamic environmental law, universal and systematic justice, and intrageneration justice are amongst the principles of Islamic justicebased development.
