امکان‌سنجی کشف حکم اخلاقی بر اساس بنای عقلا در دیدگاه اصولیون

تعیین منشا حکم اخلاقی ازجمله دغدغه‌های اصلی فیلسوفان اخلاق است. برخی اندیشمندان غربی توافق جمعی را معیار ارزش و مناط وضع احکام اخلاقی دانسته‌اند. در اندیشه اسلامی نیز اصولیون از ضابطه بنای عقلا در طریق استنباطات فقهی بهره گرفته‌اند. نظر به این مناسبات ظاهری، پژوهش حاضر درصدد برآمده با روش توصیفی‌‌تحلیلی به امکان‌سنجی وضع یا کشف حکم اخلاقی بر اساس بنای‌ عقلا در دیدگاه اصولیون بپردازد. در صورت پذیرش حجیت ذاتی و امکان‌پذیر نبودن ردع بنائات عقلایی، می‌توان مبنایی برای کشف حکم اخلاقی بر اساس بنای عقلا به دست آورد. بااین‌حال، یافته‌های پژوهش نشان می‌دهد استدلال مدافعان حجیت ذاتی بنائات عقلایی و ازجمله بدیهی عقلی دانستن آن، ایراد مبنایی و بنایی دارد و فاقد کارایی در استنباط حکم اخلاقی است. بررسی نشان می‌دهد کاربست بنای ‌عقلا در کشف احکام اخلاقی، با دشواری‌های نظری و روش‌شناختی دیگری نیز مواجه است. تمایز ماهیت حجیت و اعتبار در بنائات عقلا نسبت به ارزش‌های اخلاقی، تمایز هستی‌شناسی ارزش در نسبت‌سنجی با مناط بنای‌ عقلا، و توقیفی بودن مناطات ارزش‌ها در مقابل عقلایی و عقلی بودن بنائات عقلا، ازجمله این دشواری‌هاست.
