تزاحمِ اخلاقی حقِ تمکین مرد با حفظ جان دیگری مبتنی برحق آزادی اراده زن

اصل آزادیِ اراده و خودمختاری و نیز پیاده‌سازیِ این اصل از جانب زوجه، با حقِ تمکینِ مرد، در تزاحم است. سوال اصلی این پژوهش، پیرو همین دو راهه است. سعی نگارندگان بر این است تا با روش تحلیلی و روش‌های موجود در اخلاق کاربردی، با برون‌رفت از این تزاحم به تحقق زیست اخلاقی در خانواده کمک کنند. در پاسخ به این دوراهه، استدلال‌هایی اقامه شده است؛ برای مخالفانِ حق تمکین مرد: استدلال مبتنی بر اصل آزادی ِاراده زن، وجوب حفظ جان زن باردار، قاعده دفع ضرر محتمل، اصل همکاریِ زوجین، اصل انصاف، وجدان اخلاقی، قاعده میسور ،اصل خودآئین و برای موافقان: استدلال مبتنی بر قنوت و اطاعت‌پذیریِ زن، اصل وفاداری جنسی، لوازم قوّامیت مرد، قاعده تسلیط، و اصل سلامت و استحکام خانواده؛ نتایج نشان می‌دهد که نمی‌توان به شکل مطلق، حق تمکینِ مرد را نقض یا ابرام کرد و راه‌حل پیشنهادی، تحلیل وضعیت و تفصیل حکم است.

the moral conflict between a man's right to obey and the protection of another's life based on a woman's right to free will

the principle of freedom of will and autonomy, as well as the implementation of this principle by the wife, is in conflict with the right of submission by the husband. the main question of this research follows this crossroads. the authors try to help the realization of moral life in the family by using the analytical method and the methods available in applied ethics, by overcoming this conflict. in response to this dilemma, arguments have been put forward; for those opposed to the right of man to submit: arguments based on the principle of the woman’s free will, the obligation to protect the life of a pregnant woman, the rule of preventing possible harm, the principle of cooperation between spouses, the principle of fairness, moral conscience, and the principle of autonomy; and for those in favor: arguments based on the woman’s submission and obedience. the principle of sexual fidelity, the requirements of male strength, the rule of restraint, and the principle of family health and strength; the results show that the right of a man to obey cannot be violated or terminated in an absolute manner, and the proposed solution is to analyze the situation and detail the ruling
