راستی‌آزمایی تفکر سختی‌گرایانه در خصوص زنان با بررسی تاثیر جنسیت بر وضع احکام خاص آنان

هدف: یکی از تفکرات متداول بین زنان این است که تمام سختی‌ها، از جمله: سختی فرزندداری، درد زایمان و بارداری مربوط به زنان است؛ این مقاله در پی راستی‌آزمایی چنین تفکری، به بررسی امور عبادی، مدنی و جزایی در خصوص زنان پرداخته است. روش: برای نیل به این هدف، مصادیقی از هر موضوع بنا به درجۀ اهمیت آن، انتخاب و پس از بیان ادلّۀ فقهی، حکمت آنها بررسی شد و در تمام مراحل به دنبال پاسخگویی به این سوال بود که وجود احکام خاص در زنان، به چه علت بوده است. آیا می‌تواند به علت نوعی ترحّم بر آنان باشد که در این صورت از آن فروتری و ضعف زنان منتج شود؟ یافته‌ها: با بررسی نمونه‌های مختلف، دیده شد که در مقابل سختی‌ها، معافیتهایی در احکام خاص زنان نهاده شده که انگیزه‌ای ورای تحقیر بوده است؛ به طوری که وجود تبعیض مثبت در قوانین بین‌المللی، امروزه معادلی کوچک از این امتیازات در قوانین اسلامی است که وضع آنها حکایت از درماندگی جامعۀ غرب در ایجاد تساوی زنان و مردان دارد. نتیجه‌گیری: قرار دادن این امتیازات در زنان، در عین حال که نوعی تسهیل و تخفیف بوده است و نشان از وجود فضل و رحمت الهی دارد؛ از این لحاظ حاِئز اهمیت است که این میزان توجه و دقت نظر در وضع احکام خاص زنان، با توجه به خصوصیات روحی آنان، به واقع نشان از خالقی بی‌نظیر دارد.

Verifying Hardline Thinking about Women by Examining the Impact of Gender on Their Specific Sentences

Objectives:One of the common thoughts among women is that all the difficulties are related to the difficulty of having children, labor pains and pregnancy. This article examines the religious, civil and criminal affairs of women in order to verify such attitude.Method: In order to achieve this goal, we selected cases from each of them as a case study according to their degree of importance, and then after stating the jurisprudential arguments, we examined their wisdom and in all stages, it sought to answer the question that there are special rules in Women, what was the reason? Could it be due to a kind of pity for them, in which case it would result in the humility and weakness of women?Results : Examining various cases, it was observed that in the face of hardships, exemptions have been introduced in the special sentences of women, which was a motive beyond humiliation, so that the existence of positive discrimination in international law, today is a small equivalent of these privileges. It is in Islamic law that their status is a sign of the helplessness of Western society in creating equality between men and women.Conclusion : Putting these privileges in women, at the same time, has been a kind of facilitation and discount and shows the existence of divine grace and mercy.
