بررسی تطبیقی الزامات قانونی و استانداردهای بین المللی حاکم بر بسته‌بندی دارو و تجهیزات پزشکی

جهانی سازی در حیطه سلامت یعنی توسعه، اجرا و یکسان سازی قوانین و استانداردهای فنی کالاهای سلامت محور از جمله دارو، تجهیزات پزشکی و لوازم بهداشتی آرایشی که به تعهدات تجارت بین الملل و مقررات تجارت داخلی پیوند خورده است. بسته‌بندی عنصر ضروری هرگونه عملیات صادراتی است که نه تنها بر ایمنی، بلکه بر هزینه ها، ارتباطات و حتّی بازاریابی یک محصول تاثیر می گذارد. مسئولیت بسته‌بندی صادراتی همواره بر عهده صادرکننده است و باید اطمینان حاصل کند بسته‌بندی کالا بر اساس اینکوترمز(از اصطلاحات بین‌المللی بازرگانی، برای تفکیک هزینه‌ها و مسئولیت‌ها بین فروشنده و خریدار استفاده می‌شود) بوده و مانع از آسیب به کالا خواهد شد. به خاطر اهمیت بسته‌بندی کالاهای سلامت محور به سلامت انسان ها، سازمان تجارت جهانی، سازمان غذا و داروی آمریکا، همچنین سازمان استانداردسازی جهانی دستورالعمل ها، مقرّرات و استانداردهای ویژه ای برای بسته‌بندی کالاها در تجارت جهانی وضع نموده اند که در این پژوهش به آن ها پرداخته شده است. به منظور تعریف جایگاه بسته بندی در نظام حقوقی بین‌الملل و تعیین وظایف قانونی تولیدکنندگان؛ در این تحقیق علمی ابتدا به اهمیت بسته بندی در تجارت بین‌الملل و مسئولیت‌ها و حقوق تولیدکنندگان و تبعیت آنان از قوانین سازمان غذا و داروی آمریکا و سازمان تجارت جهانی پرداخته شده و با کشورهای مختلف مقایسه گردیده که نتایج مهم و واقعی این تحقیق ممکن است موجب ارتقاء و گسترش جایگاه بسته بندی در نظام حقوقی ایران به ویژه موجب ایجاد یک قاعده محکم در سازمان غذا و داروی کشور گردد.

Comparative Study of Legal Requirements and International Standards Governing the Packaging of Medicines and Medical Equipments

Globalization in the field of health means the development, implementation and harmonization of the rules and technical standards of healthoriented goods, including medicine, medical equipment and cosmetics, which are linked to the obligations of international trade and domestic trade regulations. Packaging is an essential element of any export operation that affects not only the safety, but also the costs, communications and even marketing of a product. The exporter is always responsible for export packaging and must ensure that the packaging of the product is based on “Incoterms” (“International Commercial Terms”: used to separate costs and responsibilities between the seller and the buyer) and will prevent damage to the product. Due to the importance of packaging healthoriented goods to human health, the World Trade Organization, the Food and Drug Administration, and the World Standardization Organization have set specific guidelines, regulations, and standards for the packaging of goods in global trade. Research has been conducted on them. In order to define the position of packaging in the international legal system and determine the legal duties of producers; In this scientific research, first of all, the importance of packaging in international trade and the responsibilities and rights of producers and their adherence to the laws of the US Food and Drug Administration and the World Trade Organization have been discussed and compared with different countries. Improving and expanding the position of packaging in the Iranian legal system, in particular, will create a strong rule in the country’s Food and Drug Administration.
